I didn't realize extradictions were done for civil law, just criminal. Guess I was wrong.

Is piracy a crime in Australia? I don't think any country is going to start extraditing their citizens for breaking US laws if what they've done is in fact not illegal where they are.

Yes. He's been fighting in the courts to be tried under Australian law rather than being extradited.

at first it SEEMS fucked up .. but then when you read more you see he was not a mere "surfer" but someone who was defrauding the system in a big way


even though he did not make money of his operations himself he actually was helping other people to make money of his actions .. many companies lost many monies because of people like him

to me it seems stupid / dumb to do what he was doing and it definatly should be seen as criminal

if he was just some dude who had an illegal XP profesional he was using for himself . .then yeah Uncle Sam has gone beserk . but no in fact he was defrauding the system in a big way . . so this should be seen as a signal to anyone who is defrauding the system in such a manner .

the case is not new .. it started in 2003 .. so yeah if you are defrauding the system in such a way you should probably consider stopping right now or realise you will be doing some hard time in some prison sooner or later . .

OK.. It's still contentious, but intellectual property theft is a criminal offense in most western countries - if you add whatever may be the substantive charges, it may well be grounds for extradition. Most western countries have ratified treaties on copyright so.....

Porn webmasters? :winkwink: Na... "porn" is not an extraditable offense in any country. Tho... CP and child abuse offenses are - and could be argued that "fake CP" (portrayal of a model as a minor) are part of that. "Fake CP" is a criminal offense in Canada, UK and plenty other countries and... could also be under USC 2256 definitions - so could be a basis for any of these countries requesting extradition on that basis. (Can only be effective if the offense is an actual offense in both countries.)

Does sound kinda weird - especially when Oz law is more than capable of judging and sentencing on this stuff and other defendants in the same operation (Buccaneer) in different countries were prosecuted in their home countries.

It is illegal in both countries or they would not extradite. It is odd they would not let him plea and be sentenced in Australia; looks like they just want to make a posterchild out of him.
