Armchair lawyers: Here's a case for you
 

Tell me if I got chance in hell of winning this. (I already have an attorney on it, I just wanna know from the "real" people.

The story:

I was talking to my brother in buttfuck, USA.... about how life sucks, suicide seems a legit way to go out.....
Moving on, the call ends.... he calls my girlfriend, tells her the whole story. She calls my shrink, and he tells her to call the police. She does.

I'm downstairs in my office doing god knows what on the computer..... the dogs are barking like fucking crazy. (not unusual).... Finally I get up and I'm yelling at the dogs as I'm going upstairs. I get upstairs to the front door, and there's a cop, pointing his gun at me through the glass. He's asking his partner "how the hell do we get in here?" Because I have fingerprint locks.... not normal doors.
So I open the door..... they grab me, slap me handcuffs and start shooting at my dogs. I'm dragged off in an ambulance to the emergency room, where they strap me down to a gurney and start injecting me with shit I have no idea what it is.
I wake up 2 days later in some deconstructed wing..... crews are ripping it apart and I'm the only mutherfucker there that isn't a construction worker.

Knocked out again.

Wake up in some normal hospital wing... with some bitch that has to watch me take a shit because I'm too much of a risk to be left alone for even 3 seconds.

Finally they let me go.

I'm charged $6,000 for this. And have no choice but to pay it or they put me in collection and fuck my credit for the next ten years.



Does this seem like a normal thing?

How are the dogs?..sounds like something you see in the movies,what were you charged with?

It would seem to me that if your girl called them and told them that you were a threat to yourself, then they probably had to come check it out. The whole bit about drawn guns, firing at dogs, etc...

that part sounds like a line was crossed.

sounds to me like you were helped involuntarily under the health and welfare institutions laws of your state. i'm not that familiar with these types of laws but if you weren't of sound mind at the time and they were acting in your best interest i am not sure you can really do anything to them.

are you in a better position now because of it?

I wasn't charged with ANYTHING.

they just fucking did this to me.

Here I am pretty sure they have to have a judge's order to hospitalize you against your will.

Sounds like something out of the movies. Reminds me of The Game. I don't understand how someone could order all of that over suicide talk unless this was some sort of multiple offense last resort type deal.

well, yes the 6 grand is something that i'd be pissed about too. i mean physically and mentally i guess. based on the story i'd say that guns drawn and the way they took you into custody sounds about right, shooting at the dogs seems a little excessive unless the caused the officers to fear for their personal safety and other means of controlling the dogs available to the officers had been exhausted. without being there i couldn't tell you for sure but i do have some experience in use of force and such and the sort. if you'd have any sort of case it may well be a property damage case depending on what they did to the house or potentially if one of the dogs was injured and killed. if the state deems they were acting in your best interest because of your mental state then you may very well be responsible for the response and costs of it.

that's funny.... my attorney seems to think I can pretty much shut that hospital down and put at least 9 cops out of work.

I just gave her a figure off the top of my head, but she didn't seem opposed to 40 million.

I think if they feel you are in danger of harming yourself,they have a right to take you down..sounds excessive force was used though..hope the dogs are ok

It's normal procedure to go to the house of someone who is allegedly suicidal and draw weapons on them from the outset?

thats why i said i don't know unless i was there and why i am speculating.

Do it then. If you can pull that off then I applaud you. However if there is a history of mental illness and they can prove that your own relatives were in fear for your life then maybe their actions have some merit, not sure how that works where you live. Will probably be a long, drawn out court battle either way. I would think they would have to of had a mental assessment done before they can start doing stuff like that.

Perhaps your psychiatrist's recommendation was all they legally needed to act.

The hospital here is WELL known for doing, let's say, "less than ethical things" in order to make money. Because they're threatened right now with a gigantic new hospital moving in.

If you think that makes sense in the case of insurance, not much else I can say there.

This would have been more fun if you had just come back saying you got a $20 million dollar settlement.

well .. maybe you can go after the procedure itself.. I mean.. did they first offered you, calmly, to go the hospital without, injecting you with anything and putting handcuffs on you? If not.. I would think you have a good case.. Also, with all those suicide hotlines out there, couldnt the cops just tell you or even force you to give them a ring a ding ding..?? I mean, you dont NEED to see a doc.. the people that call those lines certainly arent forced to talk to a doc.. Anyway, good luck

If your security system is so complex and powerful, how did the cops stroll up without you noticing? You have fingerprint locks throughout the house, a $2+ million house, and no front gate or cameras?

Well, I'm going to assume you haven't had any other trouble with the law. If you do and the police know it that might be why they came at you with guns drawn because they didn't know what you might do. If that is the case and you have had no history of violence and haven't had a history of being in the hospital with mental problems I would start with the hospital and sue everyone involved with this.

I can understand them coming to the house and I can even understand them taking you to the hospital, but taking you at gun point and knocking you out for days at a time is too much. How do they know your girlfriend isn't a bitter ex making the call just fuck with you? They can't diagnose you based on what someone told them.

If I were on a jury I would side with you (based on what you have said. If what you have said isn't the whole story then I may change my mind) and I would be okay with a pretty big award going to you. The public officials are there to help people, not drag them out of their houses at gun point and drug them for several days based only on a phone call.

They didn't. My sensor on the street caught 'em, but I figured it was a lizard walking across it. (not unusual). And the dogs caught 'em.

And the only reason they got in at all is because I opened the door, because I had NOTHING to hide.

i was a cop for 5 years. there are lots of good cops. if in fact the ones that came and got you were in the wrong then go after them. but to say that you lost all your faith in cops or whatever because of the ones you dealt with were potentially bad ones doesn't make sense.

so far i'm not convinced that you didn't go raving lunatic on them. no offense but you are known for flagrant outbursts. and before you get it wrong, i actually like you and am glad they unbanned you again.

not unusual when you have a history of mental illness. i seriously doubt they were responding in such a manner out of boredom or acting in accordance to dept standards and policies.

I thought that they are not alowed to force drugs on people if the patient does not agree with it.

In The Netherlands people are also forced on drugs, they even started to inject homeless people to be able to control them and force them to report weekly for anti-medication that will reduce the negative effects of the psychiatric drugs.

anyways generally most cops are cocksuckers (in my experience) ..there are the few good ones. But they all start off thinking they can change the city, and after awhile they think of how shitty their jobs are and resent other people

I was as polite as could be. They treated me like I just murdered the fucking president. They were about to shoot my dogs and I BEGGED them not to. Then I was hauled away and the police went through my house like it was a fucking buffet.

And by the way, my brother is a cop..... and he's the fucker that initiated this shit. And I will never forgive him. My girlfriend.... she took his lead to the next level and got the fucking swat team here.... without even bothering to CALL me first. I will never forgive her either.

And as for the way the cops acted here and treated me, my dogs, my home, and my personal property..... FUCK COPS.

honestly I find that hard to believe. the police are required to assess the situation, NOT take the word from anyone who happens to call in. If that was the case I could find any motherfucker and make up a story they called me and have the cops raid their home. That is still an infringement on your rights. Any cop should go through psych classes where they are told the warning signs of someone who is attempting suicide and those merely screaming for attention.

what should have happened is the officer taking the call ask some very key questions, from that they would have determined if there was any concern. Normally they stay away from domestic shit like that, and do not have a right to restrain you on the word of someone who is not your legal guardian. Which I am sure she doesn't have power of attorney over you. Only those with power of attorney can do something like that and even then it's difficult without a doctors assessment.

strangely that no one asked you if you had any allergies or reaction to certain medication. If not - you can now sue the hospital for injecting you with drugs that they didn't' know would harm you or not.

so outside of that, I would say you should win this hands down, since it sounds completely stupid for cops and hospital staff to go beyond their authority in what you say happened.

the cops responded to the info they got from them. thats what determined their response. i feel for ya man, i do, and i hate to say it but i don't think you have a case based on what i'm hearing. i quit being a cop because of stuff like this.

keep in mind, what i'm telling you is of my best opinion from my past experience. if what you wanted was everyone to agree with you that they fucked you up for no reason then next time say that in the thread and i will agree with you. i don't know what happened you do. if you feel you got a case go for it.

I think they could have had a little bit more tact in dealing with what ultimately was nothing.

My neighbors already knew I was insane..... now they think I'm a fucking criminal.

I personally think I have a huge case./... not only the hospital, but the police as well. I don't care if they were "doing their job"..... they need to take into account the impact of the area they're going to.
