when the little box that pops up with the contract and you click OK on that agreement... that's is a Shrink Wrap EULA (a software license agreement aka End User License Agreement) see section under "Enforceability"

shady companies put all the text in there because no ones reads it... and they make the argument that they agreed to the contract when they clicked ok to install...
