Yeah, that's a scary thought. I guess the only way to prevent something like this is to make sure your upstream provider trusts you (or more specifically your host) to believe that you are not involved and not to just shut down the web site.

Whoever this spammer is needs to chill and go make some money. As bad as it sounds, I'd rather have this guy spamming to make money rather than spamming to cause harm.

Have you been able to trace where the emails are really comming from and getting that server/network shut down?

A smart spammer will ALWAYS use blind relays....which make tracing anything next to impossible.
