Interesting how FHGs get away with stuff like that... If I put a similar form on a gallery and submitted it it wouldn't be listed anywhere... Not even by the same TGPs that list these FHGs.

Because FHG's are not made to pass submission guidelines.
They are made to make the TGP Site Owner more money by generating a higher CTR that a clean "submitted" gallery.
