say you own a youtube type site with adult content on it. 2257
The adult content is just publically posted, can you get in trouble for that with 2257?

I mean can youtube get in trouble if I decide to post some hot photos of me getting naked? :)

Anyone who posts any explicit pics of anyone other than their self must maintain records. Oh and you've got a 99% chance of getting your account deleted by Youtube.

All the video sharing sites I've seen that are geared to porn request a 2257 link but it's not mandatory.
Legally, it's hard to say whether or not the site can get in trouble. From what I understand, there are previsions in 2257 that essentially exempt certain sites from 2257 requirements if they have no reasonable control over their content. For example, this is why Google Images doesn't require 2257 statements. |

It's a complex area. some people will say youtube type of sites are simply hosts, but then if you edit/review any of the content then you are no longer a host and you are now a normal website.
That said, sites like this host porn on them so I would imagine you would need the docs to be compliant. There might be clauses in the law that might make you exempt from it, but in the end I would only trust a lawyer on this. the last thing you want to do is not have it then get inspected. |
