Hi you guys! I LOVE this forum, the site name ROCKS!! LOL..
Anyway.. I have a problem and thought that this woud be a good place to get some help...

I had made an agreement with a photographer who also agreed to build me a website if I shot with him (Im a model, btw)I went to his studio, we did the shoot ... Then he started my website the next day, but he dragged his feet on a dailly basis for the next 3-4 months, and the progress was SLOW as hell :( he made excuses every day as to why he didnt have time to do more etc...etc...
I felt helpless because I cant afford to HIRE a webmaster, and I didnt know shit about html or webdesign.
When I asked him about the merchant account, he said its in his name but I can trust him, I told him I would feel more comfortable if it was in MY name, he blew up and quit on the spot....
Anyway without boring you further...
Is there anything I can do to this guy legally for having screwed me?
I lost a lot of income potential in all that wasted time the site was down... and not functioning....

The GOOD news is that in the PINCH (and because Im a single mom struggling hard to survive) I LEARNED like OVER NIGHT how to design my own site... and its finally up!!!

I'm not in the design business.. but I could do a lot better that .. talk with one of the design people and maybe you can do a trade with them..... some content for even a half ass design.... Hell it wouldn't even have to be a design person to do better than that....

I, too, question how "for real" you are, because your question is also a bit of a spam. At least when I spam, I make no bones about it. Anyway, I don't think anyone asked for the details of your release and any agreement you might have had, if any with the photographer, and if any third party overheard anything which supports your interpretation of the events.

As a photographer who runs into models who don't understand how things work, even after explaining in detail, it wouldn't surprise me if this turned out to be a case of you thinking you understood, but didn't. I'm talking about the ownership of the photos and the financial part of the deal.

BTW, do you have the right to use the photos on your site? Check your release. It may be that the photographer owns them. Even if so, there may be a way out, but it will require an attorney. I'm not an attorney, but as someone who is explained to me, while a release is a rather one-sided document...more a pledge on the part of the model than a contract between two people...the courts will take more literally a release in which the model received what the law calls "consideration" (money, prints, whatever...but especially money). If you have received nothing from the photographer, it should be a cakewalk to have the release set aside. This is why some attorneys tell photographers, even working in a TFP (time/trade for prints) situation to give the model a $1 or $10 check.

If you don't have the right to use the photos, I suggest you take your site down immediately and see an attorney to see if you can get some control over the shots.

Recourse for what? Your time in front of the camera? No offense, but I hate this kind of shit. Every girl and her mother wants a website and wants someone to do it for them..blah blah. I have calls every freaking week from someone who knows someone I know who wants me to do a website for them for a percentage. No thank you. The model shows her tits a few times and that's the end of it for her. The real work comes in designing the site and promoting it. Traffic is way more valuable to me than time.

Anyhow, he didn't make any money from it.. we're presuming.. so you didn't lose any money from it. The time your site wasn't up doesn't count because you said yourself you couldn't hire someone to do it, so you wouldn't have had a site anyway. Consider yourself lucky you learned to do things for yourself so early on and don't expect things handed to you in the future.

And yes, make sure you can legally use the pictures. The photographer has the legal right to use them.. sucks, but that's the way it goes.

I never discuss how much my clients pay or how much I make from my photos with my models. The models will always want 50% ("the money should be evenly divided 2 ways" is the extent of the logic they apply).

BUT...who finds and develops the customer? Who puts up the site where the pics are sold? Who has to spend major bucks in order to produce the end product (cameras and other hardware, locations, transportation, film, and so on...I even maintain a huge wardrobe with lots and lots of blouses, shirts, skirts, dresses, undies, lingerie, shoes, etc.). Who spends several hours in various kinds of post-production for every hour the model was in front of the camera? Who is the one who's risking his/her money on the outcome of most of the projects? The photographer?

Finally, and perhaps the harshest point of all: models are a commodity much more than photographers. Since I'm the one with the relationship to the guy who buys the photos, if things don't work out on a deal, I'm usually the one who's still in the loop, not the model. She's just another face in the catalog.

I wouldn't have put it quite so harshly. Everyone thinks they are the most important link in the chain, but we do need models, after all.

What was I too harsh on? I love women and I love the models I work with most of the time. However, they are for the most part not businesspeople and more importantly don't want to be. They just want to model, and while we can't do our work without them, there will always be enough of them.

There is no webmaster program or service being offered and its absurd to think this post was trying to get signups at their paysite.

You might have misunderstood my point, which was exactly your point. Except in this case and in my case.. the photographer is expected to also be the webmaster and marketer of the site. I agree wholeheartedly, pay models by the hour and that's it. I have done it the percentage way in the past... no way would I do it that way again. When the money doesn't come in overnight, they get an attitude.

I guess the ironic part is, I am the 'model' also.. so I can speak from both ends which part is harder. The modeling is soo not the hard part.
