If someone sits on the .net version of your site- you sue em?

If you have a relatively popular .com and some idiot in your company didn't register the ".net" version of your domain, and a couple years later another site in direct competition with you buys the .net version of your domain and redirects it to their site, what do you do?

For example:

femjoy.com is reg'd and made a site in 01'
femjoy.net is reg'd in 03' by met-art.com folks and redirected to met-art.com

what does femjoy do?

as far as I know, doesn't matter when they reg'd it. assume that met-art just started building up google rank for it this year, and femjoy.net is now 2nd under the keyword "femjoy".

they are helping to brand your .com

who miss types .net for .com ? I dont think it works that way. I guess they are not promoting or linking the .net so It wont help to get branding but you know what i mean. They are just wasting registration fees is all.

Unless you have trademark on name, you cant sue someone.Plus if that someone is from 3th world country you still cant do anything.

they are using it for google rankings to steal the google type ins for my domain.. so when someone types in:

"mydomainname" in google search, the .net version of my domain comes up 2nd in the list and it redirects it to their site.

it was reg'd here in the states.

so I can go out and reg the .net versions of all your domain and put up similar sites and try and steal your .com traffic from google?

Doesn't matter where it was registered, if ICANN feels the domain was registered in bad faith, they will take action.

All depends on the strength of your trademark.

Simon IA Cash 02-23-2007 11:36 AM

Gotta have the trademark to be able to complain. Although, if you went as far as getting a trademark, you woulda probably bought the .net for ten bucks.

Adultnet 02-23-2007 12:12 PM

if the trademark is not registered there is nothing that you can do...
