Wow, in custody for 5 years without charge is a long time. Now he is being charged. The public are upset that he has been held in custody for five years without charge, which I think is a long time to be held, but if you accept the allegations that he is a terrorist then he deserves everything he gets.

I cant believe the amount of people here in Australia that want him freed, correct me if I am wrong you don?t just get thrown into Guantanamo Bay for no reason, he must have of had something to do with terrorism. Hicks traveled to Afghanistan in 2001 and attended a series of al-Qaida training camps.

Australians want the Australian government to bring him back to Australia to be tried by our court system which I think is an absolute joke.

I did not see the Australian Government bring back drug smuggler Schapelle Corby when she went to trial in Bali, why in hell would we want to bring David Hicks back to Australia. If you commit crimes in other countries you should be tried in their court system. Don?t come crying back here when you have broken a law in a different country.

If he is not guilty then i stand corrected, but if he is gulity which i think he is, i say let the scumbag ROT.

there are many cases of innocent people locked up in guantanamo for a loooong time without any evidence linking them to terrorist activity

um yeah you're so wrong, hundreds of people have been released without charge, probably some of them guilty but a lot of people were just rounded up, or *dobbed* in from the most dubious of sources, although most of those people were poor Afghani people just in the wrong place, David Hicks probably doesn't fall in that category. However 5 years without charge is still a joke.

This is just the media making a big deal about it... same as they did about the AWB 'scandal' which no one cared about either.

Your wrong.. if it takes 5 years for them to figure up a reason to keep him in jail you have to consider the fact that perhaps they didn't have anything..

Normally if you kidnap someone from another country and keep him as a prisoner , you charge them with a crime.. otherwise your just a kidnapper.

By your logic, everyone who is thrown in jail is guilty merely by the fact they are in jail.. i.e. if you were in guantanamo you must be guilty or you wouldnt be there right ?

Why have courts , judges, lawyers and jails then ? why not just send everyone to guntanamo , then by them being there they are automatically guilty.

In any SANE persons mind, if they have broken the law they are chraged , tried before a jury of your peers iin a timely fashion and convicted if your guilty. Why some people think we need to suddenly drop the justice system entirely for some people is beyond me..

None of those at GITMO could be charged until recently because civilian attorneys had the matter tied up in the Courts as to them being tried in a civilian court vs a military tribunal. The Supreme Court ruled a few months ago that they could be tried by military tribunal, but not as the Administration had established the procedures for the military tribunal. The Sumpreme Court ruled that the Congress had to establish the procedures and they have now done so. Presumably some of those at GITMO will now begin to be charged and tried by military tribunal. It is my understanding the the US has determined that, I think, a hundred or more (I don't really recall the number well) can be released but no countries thus far will accept them, including their countries of origin. It is also my understanding that over the years several hundred have previously been released. A few of which have been captured once again, or killed on the battle field.

Maybe some one can refresh my memory on the number that are eligible for release but no countries will accept.
