Of course stealing is wrong but it's interesting that somehow the US courts have power over people or entities in other countries. If I'm a Japanese citizen, for example, and someone in the US sues me, and I say "fuck you, I'm not showing up to court" then how can they do anything? Are they going to show up in Japan and arrest me? I don't get it.

Ayla, The end result would be a default judgement, with no ability for that judgement to be fulfilled.

However, if any of your business touched the US, in theory the collection agents could get really nasty and make it very difficult for you to continue to work in the US.

This could get ugly.

all I can say is that guerilla webmasters - don't panic over this and jump ship - watch carefully what is happening and be smart rather than reacting too quickly - we still haven't heard the other side of the story yet

I do not speak for guerilla at all - if you read what was said - I was commenting that I hope that webmasters don't suddenly read this report and cancel with guerilla too quickly without hearing from them first or following along the news. Far too often webmasters simply jump on a bandwagon.

Of course I am letting the courts settle this out - as with any company if something is posted, I prefer to not react to quickly. I was only giving advice.

thanks for clarifying... i never jump ship due to legal issues.. nor would i hope any affiliate would...

if it turns out that gt was using stolen content, i would not be willing to promote them....

A convention is perfect. The effect of serving papers should not only be to make the legal statement, but also to being the public shaming part of the whole deal. IMHO Falcon chose exactly the right time and place to serve people that are likely not in the US all that often.

people who live on the other side of the world arent always easy to serve with papers. i think internext is the best place to do it.

The United States has treaties with many foreign countries (including Canada and Japan) that allow citizens of one country who receives a court judgment against an entity in the other country to enter that judgment in a court of the defendant's county and get execution on the judgment in the country of the defendant. This is generally referred to as the "full faith and credit of judgments" provision in those treaties.

If you happen to read this, drop me a line sometime. My brother is an attorney. He was a deputy prosecutor for several years and now represents the county in certain family law matters, if you follow. Anyway, I've been telling him for years that when he decides to finally go into private practice he should think outside the box as far as what area to get into. I'd LOVE to put you two in contact.
