My fiance got hit by a car :(
 
Thank god she didn't break a bone! She was riding a bike and some 16 year old girl just slammed right into her. She was going about 10mph when she slammed into my girl and knocked her off the bike. My girl did not break a bone but she has some pretty bad scrapes and bruises and she can barely walk or mover her elbow. The damn 16 year old had a suspended license so she shouldn't even be driving. Happy New Years to us huh? :disgust

Yes. She had a license but she quit school and in Florida if you quit school your license gets suspended until you start school again o you turn 18, which ever happens first.

Yeah sue both the parents and the 16yr old. States vary by whom would be responsible, though I would guess the parents still own the car. Yet just in case make sure who owns the title on the car and sue them as well.

Keep track of everything as well. From mileage to the smallest fee's incurred. Save those receipts.

Since our society doesn't shun these people, and parents don't seem to really give a shit what their kids do, suing them is a nice way to send a big fuck you to them for being shitty parents and hopefully teach them to take some responsibility.

You're blaming the wrong party. It's not the lawsuit that raises your rates, it's the moron drivers who don't have licenses that raise your rates. Blame our government for not being stricter on criminals. The girl will go to court and get a slap on the wrist and will do it again.

There are consequences for actions in our country. If someone steals money from you, you can sue them. If someone kills someone in your family and causes you pain, you can sue them. It's not the best form of justice, but it is a form of justice.

I do agree that there are a lot of bullshit lawsuits, but there are also legit ones. If a drunk driver totals your car, puts you in the hospital for a month, are you going to shrug, shake his hand and say accidents happen?

Okay guys, let me clear something up. I speak with authority because I used to work in a law office and we did a lot of this stuff.

This case might be worth $1,000 . . . . tops. The lawyer will get $333, the doctor will get $333, and she will get $333.

Personal injury lawsuit settlements are based on medical bills and pain and suffering (usually factored by how much therapy they had to undergo to recover). How much do you think those are?
