Is this a joke? C&D because of using the work revshare...
 

Just received a C&D because we use the word revshare on statsremote.com. The funny thing is that the only pages where it's used are pages where affiliate programs are listed that have the word 'revshare' in their name.

If it is from Revshare.com, tell them to fuck off & pound sand as use of the term revshare began in this industry well before this company even incorporated itself.

Ibill on the other hand looks like they took a well used term within the industry & TM it in spite.

How can they claim first use when use of the term within this industry started well before Ibill's inception? Ibill certainly did not coin the term.

Good, now you can tell them to fuck off. You're not in the business of disseminating advertising to television, therefore you're not in same type of business, & whereas they're using the term as name of their company, you & any other affiliate program, etc, are using the term as abbreviation as the word was coined to be for revenue sharing. Tell them to fuck off. Actually, don't do that.. have an attorney look at it.



personally, now I think we should all contact uspto & advise them & petition that the term revshare is a generic term & not a unique one, therefore is not eligible for tm protections.

So they own revshare.com.....I don't see how they can C / D you with only a domain....

If we actually used the term revshare I might but we only list programs that use it as part of their name and the C&D was only sent by email, so I definitely won't...

its their business model now. they need to make money to pay back everyone.

Alot of intellectual property law centers on "first use."

When did they begin using the name? When did you begin using the name?

Another thing to look at is how many other domain names contain that term.

People were named McDonald well before there was a resturant.

They could sue everyone for infringing on their trademark and make a comeback! They are saying they used it in 1995.
