DialerCo is cheating Ezdialeronline of $60,000 PLEASE READ

I just want everyone to know that dialerco sucks big time!

DialerCo is refusing to pay me or my resellers for calls for the period of march to july for what they claim is a violation of their policies. During an unauthorized search of my server (via FTP, not via the web like all dialer users would access my site), they found old, unused remnants of design work that contained incest/rape stories in txt format. This old work was not available on my site through the members area, or via any means other than via ftp. A review of my server logs confirms that these files have NEVER been accessed via the web. Yet, the mere existence of these files is cited by DialerCo as a violation of their policies. Their response to my request to demonstrate how these files could ever have been accessed by a dialer user was the following: "It does not matter whether the content is accessible though a valid link or not.".

So, they feel that they are free to explore the entire contents of any server hosting your content and hold you liable for anything they find on this server, regardless of the fact that it was never available on the web! Here is their reasoning for this: "You offered DialerCo FTP access to your server, without any conditions, so we are/were completely within our power and rights to view ALL of your server content.". So regardless who owns the content, regardless of it's availability from the web, if it's on a server hosting your content, DialerCo will withhold payment to you and all your reseller/webmasters.

My resellers are run their own custom dialers, directing traffic to their own content. Other than the fact that they came to DialerCo through me, there is no connection to me or my content site, yet payment for the calls generated by these resellers promoting sites that are entirely different is being withheld as well.

Just when you think DialerCo could not sink any lower, now they are directly pursuing my resellers and webmasters trying to take them away from me. You see, this whole thing has nothing to do with some old .txt files sitting on my server, it is because I was making preparations to leave DialerCo and they are trying to punish me, by withholding over $60,000 and then stealing my resellers and webmasters.

Deal with DialerCo at your own risk. They will invent reasons to withhold payment from you and then move to steal your resellers and webmasters immediately after.

Very dirty, very low, very shameful. DialerCo, your reputation will catch up with you, you can't keep screwing Resellers and expect to get away with it forever.

Let me get this straight- you have a server, it has some files on it that violate the terms of service of a dialer program you participated in, you got canned from the program because of this, and you now need to vent because you either
1) feel those files should never have been found,
2) feel they had no reason to be checking your site (ala unresonable search and seizure!) or
3) even though you have this shit on your site (I mean, it's not like you accidently downloaded something from the internet to your personal computer one time and didn't know how to erase the evidence- you uploaded the files in question, hosted them for download [it doesn't make a rat's ass if anyone did download them, whether you can prove no one downloaded them in the meantime or not- they WERE accessable via the Web] and left them there) you feel that you should be paid for business you sent in contradiction to their terms.

Guess what? Terms are terms, you violate them at your own risk. If you feel that the circumstances regarding your violation somehow don't apply, you're mistaken. Mistakes can be costly- as you've repeatedly pointed out to us. Thank-you for the warning. We all now realise the need to play by the rules, or get out of the game...

Actually if you guys read into all the threads and posts, you'll see that DialerCo is completely in the wrong here.

They were using his members area for their dialers. This questionable content (stories like this aren't illegal...just sick fantasy) were there BEFORE DialerCo linked to him.

There was a question of whether or not DialerCo should have been snooping on his server, when they had access to make changes to .htaccess files. After reading their TOC, you'll see that they're allowed to perform audits of affiliated servers...but must provide 3 days notice. They didn't do this, and broke their own terms of service.

They were just looking for a reason to not have to pay him. Sounds likd some other webmaster programs and sponsors who will remain nameless...but we all know real well.

Hopefully NINO will FUCK DialerCo hard...just as ANY CHEATING ASSHOLES should be.

Well, actually, I have read all the threads and posts on this issue. However, repitition doesn't make truth.

They all say the same thing- the poster has material on his servers that's in violation of the terms of the dialer program he's promoting. He got canned for this. He feels the files should not be considered because they were never downloaded by anyone, he swears this is true and can furnish log files to prove it. Oh, and he feels they souldn't have been checking to see if stuff like this was "laying around" to be downloaded in the first place.

But the files were on his server, nonetheless. I didn't put 'em there- did you???

Bottom line: You get caught, learn not to do things that'll catch you out - don't look for sympathy.

If so, then why wasn't it posted in the orginal thread? Seems <i>quite</i> doubtful to me. Either way, i don't really care. Eventually, all the dialer resellers and major dialers will die. BWAHAHAHAHAH!! DIE I SAY!!

Nope. First off, Nino or whatever alias he chooses to use today.... admitted to having questionable material such as rape and incest stories. Even these are against DialerCo's policies depending on how broadly you read into them....

DialerCo then released an announcement showing a screen capture of the other files. Alias Nino then admitted, I believe, to having the CP stories on his server also. Comes down to it *somewhere* along the way, Nino did break the TOS.... if DialerCo did also by snooping his server is another matter.

This is something which needs to be settled by both parties' attorneys, not a messageboard. Public opinion is not going to change a thing here and certainly not going to get Nino $60,000. There is obviously something wrong because Nino is still posting on this issue instead of taking the advice he was given to contact an attorney in the first place.

I don't understand how companies like that can get soooo damn backed up with Pay. I use Dialer Access and am actually a reseller for them, having a few people under me.

They pay weekly for the previous week, so after a pay period closes, I get my money the following week.

After this last Telco ordeal, I know that I wouldn't wait to get paid. If something ever did happen with Dialer Access, at least me and my people would only be out of one week's worth of pay.

its like this, Dialerco never found any incest/rape stories in txt format that was only a lie because the owner Nino had started his own dialer network and they did not want to pay out the $60.000 Nino have told Dialerco that they can post all the stuff on the board that they have seen or whatever they have ....
But they dont... they dont even answer his emails...

And Nino have never had this stuff on the server, if there where someone who had it it must have been dialerco that uploaded it!

The part I am interested is that I have hear that DialerCo are not paying the resellers which seems slightly unfair. Shouldn't the resellers be able to contest this ?

I hate diallers anyway and especially the way some webmaters use them, trick links and try and con you into downloading the dialler prog.
