1 - No. The inspections are a function of the DOJ and FBI, neither of whom take their marching orders from Congress.

2 - I'd say yes, it did 'help' them, even though an inspection did take place.

The FBI conducted the inspection in what appears to be a clear violation of the preliminary injunction obtained by the FSC in FSC v. Gonzales.

The FBI and DOJ have been getting an earful about that one from Jeffrey Douglas (board chair of the FSC and attorney for the company in question) ever since that inspection went down, and can expect the same from the judge in the case, I'd wager.

I think TT Boy's company was a secondary producer. Sounds like the secondary producer protection was "worthless" as far as the inspectors were concerned. Getting an earful? Let's hope it has more teeth than that.

The Supreme Court on May 13, 2002, issued a decision on Congress's latest attempt to censor the Internet. The Court did not decide any of the core legal questions, but ordered a lower court to decide the case on a wider range of First Amendment issues. Meanwhile, a majority of justices appeared to have grave doubts about the law's ultimate constitutionality, and the Court left in place an injunction barring enforcement of the law. The case has to do with a law passed by Congress in 1998 called the Child Online Protection Act (COPA), a broad censorship law that severely restricts any speech on the Web that is "harmful to minors," and imposes steep fines and prison terms for violators.

My imaginary scenario: FBI guys show up. The guy at the shop whips out his printed secondary producer protection, holds it proudly in front of him, expecting the FBI guys to leave dejectedly. FBI guy says let me read that while we are shining a flashlight in your orafices and seeing if you may have rolling papers lying around anywhere. Upon reading it he says "Hmmm, We will get back to you on this." "I need to go to the bathroom, where is it?" says the FBI guy. "first door on the left" says the shop guy. A minute or two later FBI guy emerges from the bathroom while another FBI guy has his gloved hand all the way up the arse of the shop guy. "Excuse me" says the FBI guy, "you are out of toilet paper, can I borrow that piece of paper you showed me when we got here?" :1orglaugh
