Got in car accident, now having problems with other party
 
About 1 month ago my wife bumped into someone elses car in a parking lot. They both decided to settle this without involving insurance companies. My wife found a repair place that fixs it for approx. $500can however that other person found a place that repairs it for $1000 and she insists on using them otherwise she will go through the insurance company.. we're not sure of the procedure (do we pick? does she pick? Can she use Insurance Co. still now?).. any help is appreciated.

Yes, she can still contact your insurance company. In the states, parking lots are usually not covered under traffic laws. She could get a police report for the insurance company, but the police couldn't write your wife a ticket or anything.

Personally, I'd pay the $1000 but BE SURE TO GET IT IN WRITING THAT IT'S PAYMENT IN FULL. You don't want her coming back in a year saying her neck hurts.

you're at their mercy. pay it and be done with it. your insurance will go up and prob far more than 500 extra a year. they know they got you. you haven't a choice at this point.

Happened to me too long ago, it sucks, theyll just get the car done for 500 and put the 500 in their wallets.

It depends where in Canada you are.

In British Columbia, for instance, everyone has to have ICBC insurance. When a claim is made against your insurance, you always have the option to pay off the accident instead of it being an outstanding claim. So you can just let the insurance company handle it, and believe me they won't pay the highest estimate, they'll pay their own estimate, then pay it off once it's settled.

Interestingly enough, towing is included and doesn't factor in to what you pay the insurance company in the end. It's free!

Another note is you must be sure to pay the accident as soon as it's been settled with the insurance company, because if you have another accident, you will lose the option to pay off the first.

Tell them to eat a bag of shit. In Ontario they (and you) have 24 hours to go to a reporting centre and get the stupid paperwork from the police. At this point with no police report its their word against yours.

Offer them $500 or a bag of shit. They will likely go for the $500.

2. They better take our lowest offer to repair if they want us to pay for the repair at all.

I like the $500 or a "bag of shit" option personally :)

I'd put my money on she knows someone at the other garage that will fix it for way under $1000 and the extra cash will go in their pocket.I'd tell them take the $500 or report it.

Happened to me. Chalk it up to a learning experience. I did have some fun with the other party. I told them that I would pay the shop directly and gave my visa number to the shop...only to be billed when the repairs were finished.

Got the call to approve the work and to charge my visa. Asked the service person how long I had to approve it till storage fees started. Was told three days, and I said I would wait the three days.

The other party was pissed and when they called I just said you pay the bill or wait...they waited :Oh crap

Let them take it to the place for $1000. I would go there personally and pay the repair place myself. That way you know the real cost and you can get in writing from the person fixing the car that you paid for the damages.

bumper replacement or touch up is 5 hours max, no fucking car rental fees, one cab for the day would cost less.
