Is this legal?

Would umm... let's say Sony mind if I took a picture of my TV (clearly a sony, logo visible etc) and add it to my adult designs?
Or, is the TV mine, and I can do whatever I please with it, and pictures of it?
TV was just an example. Can I use anything that I own? Comp, cellphone, refridgerator, oven, whatever?

is the logo important to what you're using it for? airbrush it out

eRock 07-02-2002 11:18 AM

You might have probs w/ the logo...

Jakke PNG 07-02-2002 11:23 AM

That wasn't the point. The point was mostly:

Can I use my own stuff unedited for designs?
I can airbrush the logo out, np.. but it's extra hassle. :)

You can probably get away with no issues, but if they see it and notice that you are profiting from that page with the logo... you might have some issues there.

Personally I would hate to see my logo on someone else's site without my consent.

tape over it with appropriately colored tape

aka black tv black electrical tape, white fridge white duct tape etc

Legally you're pretty alright, if you can prove its a picture of your TV.

just take the logo off man.

:winkwink:

I know I heard some director complaining that they had to blur the inside of the video store - as to not show the tapes/posters for possible copyright infringment.

I also heard a story from the last internext from a photogrpaher giving a presentation saying that he (or one f his buddies - can't remember) had done a shoot in the hard rock cafe hotel and was told that if so much as one matchbook was on the tape (with the hard rock cafe logo) - he would be sued.

I think your chances of getting in trouble are pretty small, and I think it would fall under far use - as long as her nipple wasn't like holding the "o" in "SONY" up.

They almost certainly wouldn't do anything with out asking you to change it first - and would probably not find out anyway.

Anyway - I don't know what the law is for sure, but I doubt you are going to get in any trouble. Worse case is you'd get a letter from their lawyer asking you to stop.

Just so you know - sony is more litigious than most (remember sony's restaurant that was a woman's name! - not anymore) - same with paramount and dr. seuss.

You don't want to mess with those big corporations.
They love to wield they're big sticks.

Good question though!

Not sure where the logo is located on whatever you're concerned with, but if it's low, just put something in front of it that would blend with the rest of the scene... the tape thing is good too.

If you're designing the page and working with graphics anyway... it would only take a sec to brush the logo out..

If you have any doubts, I'd get rid of it and not have it to wonder about.

Just because it's yours doesn't mean anything regarding the trademarks and copyrights, I don't think. Can you scan your copy of Playboy and put it on your website? Can you copy your new Eminem CD and put it on Napster?

AHh... but can I take a picture of myself holding a new playboy or eminem CD and post them in the web? What if I have a Armani T-shirt? Do I have to blur the logo?

Jayson 07-02-2002 05:21 PM

I think if you took a photo of you holding a playboy and used it as part of an adult site then all shit would break loose.

Again, you could use the Sony logo but given you are using it for commercial purposes it changes the rules a bit.
