Is it legal for employers to gossip about former employees?

I thought the only thing you can legally say is if they were fired with cause.

Don't think there are any criminal things that will happen if you say something about an ex-employee. Like they are not going to throw you in jail? Not an attorney. I'd never say anything bad, so it is a glowing referral or no comment at all.

yes it is illegal is most US states to defame an ex employee, most just allow you to state the dates of employment, if they resigned or were asked to leave, and if they are eligible for re-hire.

i dont think the ex-employee would have to sue on thier own dime, as it is a law on the books in many states, they would just half to report it and provide proof.
