Dilema regarding a domain. Am I cybersquatting?
 

guys, i have a dilema and need your opinion. now, since were talking about a domain that has not been registered yet, i cant reveal the name of it, so im making up a name just to get the story out.

remember, the domain names are fictional

i own pussypink.com, and was gonna get pussyred.com and make it the sister site to pussypink.com
well, it turns out pussyred.com is already taken and already in use
if i get pussyreds.com, would that be reasonable? or is this guy gonna think im cybersquatting or trying to take advantage of his site? what do you think? I do not want to be trying to immitate him or have him think that is what i am doing...

should I register pussyreds.com and develope the site, or would that be unfair to this guy? What should I do in this situation?

Unless the site is a big trademarked company/name, you will have no trouble. Like, you could get in trouble for thehuns.net but not for mypussyfiles.com

Or unless you decided to copy his layout and steal his content :(

well, the site is not that big actually...not anything famous
but my dilema is that i would be upset if someoen did this to me, so thats why im in a bind. I dont wanna be a hypocryte, and do the same thing that i hate someone else doing to me

You can register the domain no problem.

some people think when they register a domain, they own every extension & every variation of the domain.
This isn't always true.

If you register a domain like mcdonaldz.com it would be risky, but if someone has the domain: hotsex.com, and you like the name then register it under a different extension if you like.
They can't do shit.
I've read about a few cases where some fuck tries to sue another person for using a similar domain and the guy who is sueing always loses, unless the domain in question is a trademark or a celeb name. Then it gets more complicated.

We have no idea if the domain you're talking about is generic and no idea if the other person has a trademark. What you want to do is a very common practice and in many cases it's perfectly fine. In some cases, though, you might find your self getting hit with a lawsuit or a WIPO case.

Without knowing the specific name and the person who owns it, then it's hard to say.

If he has a trademark, then you shouldn't do it.

now, one other issue i have is although the my site will have a different niche then his site, the design of the two sites will be somewhat similar. Its hard tio explain witout giving away the domain (dont want some gfy lurker registering it) but basically, the domains in question contain a animal name in it, and on his site, he has pictures of this animal, and on my site, i want to have pictyures of the same animal...so in that regard, both the sites will have the same exact component.

how do you guys feel about that? does that change things? the important thing here is that i dont want to screw this guy, just because he is a small timer and couldnt fight back.

If there is no trademark & you are not copying the guys design you should be fine. If your domain is similar and your layout is similar it might piss him off though.
