Providence, RI (AHN) - A judge dismissed a Rhode Island man's claim over a penile implant that caused him to have an erection for 10 years.

The implant manufacturer asked the court to dismiss a judgment that gave Charles "Chick" Lennon $400,000.

Superior Court Judge Edward C. Clifton granted the request, which would amount to $1 million with interest.

National Union Fire Insurance Company argued that because the implant's manufacturer Dacomed Corp. cannot be held liable for the defect, it should not be held accountable either. Dacomed is now out of business.

Lennon's lawyers contend that the Rhode Island Supreme Court approved the award and told the insurer to pay it.

The 68-year-old handyman was implanted with the plastic device in 1996, about two years before Viagra was sold to the public.

Impotent men can position the Dura-II implant upward for sex, and then lower it afterwards.

However, Lennon said he can't move the penis downward because the implant is defective. He told the court this has caused him pain and embarrassment.
