GFY post leads to lawsuit..

I know by now everyone has heard of the xpays lawsuit against flashcash's mrskin and some others , but i found this particular part of the criminal complaint kind of funny..

--------------------------------------------------

On May 18, 2006, an authorized representative of ICG, who was clearly
acting on behalf of ICG, posted a number of statements on the popular adult
webmaster board on www.gfy.com accusing XPays of failing to pay monies owed to
ICG and of being financially insolvent (collectively, the ?False Statements?).
Although XPays promptly proved that it had paid all monies owed to ICG, and then
demanded that ICG post an immediate retraction before any further damage could be
done, ICG refused to do so (and still has not done so). XPays is informed and
believes that a number business relationships that it has formed and cultivated over
many years have been damaged as a result of ICG?s malicious conduct. ICG is well
aware that accusing a company like XPays, whose success depends largely upon its
relationship with the many affiliates who regularly post on www.gfy.com, of not being
able to pay its affiliates will cause substantial and irreparable harm thereto.

------------------------------------------

heres the actual transcript (- not an actual transcript -)

ICG - hey xpays you owe us money
XPAYS - do not , do not
ICG - I hear xpays is broke and cant pay ..
XPAYS - why you skanky mudflap you better take that back

XPAYS fine see u in court

i posted their cancelled checks with dates of clearance and requested a retraction multiple times. Our claims are crystal clear in the complaint and I will now direct those who have not read the complaint to click the following link and inspect it:

XPays 09-15-2006 02:49 PM

And I will not be muzzled. The confusion in the marketplace is going to be history as it relates to our business. :thumbsup

chaze 09-15-2006 02:52 PM

You can sue anyone for anything, why not for GFY drama? :1orglaugh

Scootermuze 09-15-2006 02:52 PM

It may or may not stick...
Lawyers usually try to add as much as they can as they build a case.. Then the judge goes down the list and decides which to keep and which to toss out..

Kinda one of those, "Let's give it a shot" deals..

huey 09-15-2006 02:55 PM

It will be great when whosever lawyer asks what GFY stands for.
Case closed.

smokingdawn 09-15-2006 02:57 PM

This should be interesting

It makes absolutely no difference if there is profanity. Profanity is a regular part of society and the courts are concerned with the merits of any case. Same goes for the adult nature of content btw.

Sure if you can show actual damage. Nobodies rep gets hurt around here nearly ever it seems. You can show someone is ripping someone off, it can go 8 pages and be full of actual proof and if someone got an ipod from the person ripping the other off, all is forgiven. If not wait a week or two and everyone has forgotten. Main reason why scamers can do sp well around here. People rarely remember or take anything seriously around here.

notabook 09-15-2006 03:04 PM

You can sue over anything these days. Man, the sandwich I just ate from Arby's didn't have quite enough roast beef on it. I think I'm going to sue them because of my dissatisfaction from the service rendered.

I don't know how American law differs, but up here even if the statements are true you can be sued.

For example, if you go on a board like GFY and say Company X is shaving (assuming they are) and they suck blah blah blah, you can be held liable for the damages it may cause their business.
