Yo Americans - what do you know about your laws about magic mushrooms
 

And more specifically mushroom growkits. These kits contain spores from mushrooms and dirt. So no actual mushrooms.

The reason i'm asking is i sell these kits online...within Europe. Now i mention on my site that i don't ship to the US with the only reason that the US is pretty damn strict with anything drug related.

So i get quite some Americans who mail me and want to order and i always turn them down.

So a while back this guy mailed me and linked me to several mushroom related articles and the laws related to them and to be honest i could not find anything that said growkits are not allowed and not even that mushrooms are illegal. I only found something about 3 states where they are not legal.

Can anybody help me out here? I'd really love to open my shop to American's.

i had a great trip with some friends back in 01...don't think i'll do it again though...

fuck magic mushrooms, they make me feel well bad.

you can have spores, and last i heard you can even have the shrooms as long as they're not dried out and ready for distribution.

if i were you, id have a lawyer look at the legalities of it rather than asking the a forum with the average IQ of a walnut.

Oh yes, before i open my shop for Americans i certainly would hire a lawyer i just figured that if someone here can point me to something that clearly mentions its illegal over there i dont have to hire a laywer at all.

I am almost positive you can send the spores to the United States, but I don't know about "grow kits". I think that would be illegal in every state because you're cultivating them.

By how you're explaining it, it sounds like you're sending the jar with everything ready in it and all the person would have to do is wait for the shrooms to grow... It would kind of be like sending a grow pot with a cannabis seed in it and then letting the person wait for it to grow. As soon as you plant a cannabis seed in the United States it is against the law, so I assume it is the same with shrooms.

The point is, the whole cultivation thing from the get-go is illegal. The spore thing isn't illegal because it hasn't yet been used for criminal purposes (growing).

Maybe sell the spores and then direct your customers to http://www.shroomery.org/ . That way, you are just selling spores and not a cultivation kit.

Again, I'm not positive on the laws - but by how you explain it, it seems illegal to me.

But, if it is just dirt and spores seperate, I don't see a problem. I'd send them in different packages though. :)

I think you are right...at least this was my guess as well. And my next option is opening a spores store.

Wow... very impressive growing. I've done shrooms twice and had one bad experience with them, so I'm done with those things for good. Nice growing though, very impressive.

Those kits are crazy. You can get 3 to 5 big flushes out of 1 kit...enough mushrooms for a whole family :)

Sooo tempting.....it's Psylocibe (sp?) season here soon but must resist. Not taken any hallucinagens for years. Used to eat them like candy in picking season many many moons ago, week long sessions of manic-ness and sheer bloody wierdness camping out on the moors.

I've bought and grown them in canada .. yes I know that's not the US , but we have a few million people here :)

I bought them in the store for $40 ( spores ) and then tripped my ass off for a few months after !

You can sell the spores in canada , I'm unsure of the grow kits tho .. I bought mine as a spore solution

You can buy a full grow kit complete with the spores at a local store here in the DFW area. Im not sure if it's actually legal or just overlooked.
