So I paid this guy to make content for me and he made some home videos (no one professional) just a 70's type pornstar haha...... anyways while he's pounding these chicks he's got Music going on in the background, like popular songs does this
matter?

I think you cannot sell them with that music there
unless you are willing to negotiate paying the record label a royalty fee.

You cant use the sound

We had a prob with this back in the day, girls on cams like to listen to music but we had to tell them no, because as long as we are broadcasting live, the music cannot.

The music has to go or you will be hearing from the record company..If you are good with audio equipment you can dub it out and replace it or forget the music all together.

You definatley cannot use the sound in the background unless you buy a commercial license to use it.

Your problem may be that you probably wont be able to buy a license for it given its porn.

Best bit is to get a sound engineer to take it out, but that may not be cheap either.

Another option is to try and record the vocals again.

If you think APIC are a problem, you have no idea of what the record industry equivilent are like. Especially if it's an artist who does not want to be on a porn movie.

Not much at all and I got camera man, photo guy, two girls and a pornstar and a mansion to film it in, they just made the mistake of filming it with music on, and they made it too loud so you cant hear the fucking people in the porn grr, i am talking to the guy tommorow and telling him I cant use this shit, better safe then sorry

they're trying to get restaurants to pay a fee if they have the radio playing or some shit. at least that's what i remember reading a while ago.

It has been my understanding that you cannot use music in a movie without permission. It doesn't matter if it's a documentary, an indie film, a porno, or anything else. You can't use it without a release.

Even those skate/surf movies get releases from the bands.

i think you're right. you can't use it for anything but *possibly* educational (in the not-for-profit way) - but i could be wrong there too. maybe i'm just thinking of citing quotations and such.
