Fuck you state farm insurance
So...In reference to me getting rear ended last night...I call up State Farm today to find out how they want me to handle getting my vehicle repaired...
To my surprise...the other 2 drivers (They both use State Farm...I use Geico) have no reported the accident to State Farm. The other two vehicles were both towed... So now...I'm stuck sitting here...State Farm was like...Did you call your insurance company? Fuck no I didnt...It isn't my fault that I was sitting still in traffic and 2 of YOUR policy holders hit me... So...I'm suppose to call back tomorrow to find out what the researchers found out... So...a big fuck you to State Farm Insurance... I have another vehicle but thats besides the point...The point is wtf I'm suppose to sit around with no vehicle while you get your shit straight? |

You always call your own insurance company no matter who was at fault.

State Farm's duty is to their policy holder, not you. Contact your insurance company so any necessary notice to the state will be made.

I know everyone is saying contact your own insurance policy...The issue with that is...I've never had a claim with my insurance company...I've never had anything at fault or any problems...I shouldn't have to report it to my insurance policy that someone else hit me...Insurance companies love to jack up rates regardless of whos fault...So instead of involving my insurance company I am going straight to theirs...After all...I was sitting still whenever 2 cars plowed into the back of me...

State Farm is seriously fucked from several accounts I've heard and seen...
I remember many people after Hurricane Andrew got seriously fuckkkkked over by them. Since that time I won't consider them, and sadly watched some 20/20 or Dateline thing on TV the other night about them fucking people over in Katrina...not shocked :/ Sorry to hear you're having problems...get a lawyer if need be, or move on and spread the word. That company is a real piece of *work*. PS: I had a vehicle stolen before, and although I paid slightly higher premiums with Allstate, when I filled out the claim, including a good chunk of equipment I had inside the vehicle, they didn't drag their ass or low ball me. They cut me a nice fat check, smiled and moved on. I never mind paying extra for good service and coverage like that. :thumbsup |

My dad used to use State Farm and did for over 30 years never filed a claim or nothing. Well one day driving down the interstate he is slammed in the ass end by a semi. They both turned it into their insurance company. State Farm wanted to total the vehicle but dad wanted it fixed so they send him a check for some value they came up with and my dad tore up the check. My dad said no I want it fixed. Well this went on for awhile and finally my dad went after issurance company of the semi driver, they paid for the vehicle to get fixed plus a rental for the whole time he's vehicle was getting fixed. Needless to say he switched insurance companies. |

i would contact your insurance company thats what you pay them for they will contact state farm for you and handle all the bullshit your insurance shouldn't go up
they'll base the incident report upon the police report so depending on what hte police reports says will determine the outcome of who's at fault... in new jersey if your rear ended the person who rear ended you is automatically at fault i'm sure it varies from state to state check with your insurance company the worst thing you could do is wait to contact your insurance company... they will tell you the exact same thing a few people in this thread have "why haven't you contacted us" your insurance company expects you to make the phone call to them and let them know hey i was in an accident, even though it's not your fault... thats how your vehicle will be fixed, your insurance company will contact their insurance company file the claim, if they agree with the claim you get payment if not they dispute and your insurance company will take them to court to get your money either way your premium shouldn't go up |

Yes...My insurance company will be contacted...This I know...But I am trying to deal directly with State Farm as I don't want any claims on my insurance...If that makes sense?

If there's over 500$ in damage, you're obligated to report it to the police, as far as I know. Then at least there is a record of the accident that all the insurance companies can reference.

It dosent matter if they called and reported it to thier insurance companies or not. Tell them that you HAVE A CLAIM AGAINST THIER POLICIES and you want an adjuster sent out. Send them a copy of the police report. Thats all they need, they dont need thier clients to call them, thats just a delay tactic. How much damage is involved? If the amount you stand to recover is less than the small claims limit in your state, just file a small claims suit against the other drivers (not thier insurance companies, you sue the drivers, not thier insurance companies) and when the summons come you can bet the drivers will be in touch with thier insurance agents demanding that thier insurance company defend them against the suits, which they will do. I have been involved in three car accidents in my life, all not at fault according to the cops. All of the people that hit me were insured by State Farm or All State. Both of which are extemely miserable to deal with. I have found its best not to screw around with all thier little bullshit tactics. If you have injuries, get a lawyer. If its just PD, sue them and represent yourself. Lawyers wont touch those cases anyway on contingency and it wouldnt be cost effective to hire them by the hour. Get three estimates (at DEALERS, using OEM parts only, who will charge more, let the insurance company argue that it can be done cheaper elsewhere, where you counter that you didnt have aftermarket parts on your car before you got hit so there is no reason they should be able to replace them with substandard parts) and demand the average of the three estimates as damages, throw on some rental car charges and such. |

BTW, with regard to rental cars: Rent the same kind of car as your car, or as close as you can get. If you drive a Hummer, rent a Hummer. If you drive a van, rent a van. If you drive a compact, rent a compact. Dont worry about how much it costs, thats not your problem its thiers. The insurance companies will always argue that you should have rented the cheapest thing the rental place offers. Dont fall for it. You bought a certain level of car to fit your needs and lifestyle, and those needs didnt change because thier clients negligently hit you. Make this point loud and clear when they start bickering with you about this.

Ins. co.'s are just a group of agents and lawyers and they'll take your attempts with a grain of salt and play you like a fiddle... Just let your ins. co. deal with it.. They know the ropes and they'll work in your best interest.. They do it all day everyday.. |
Holy moly the guy wants to deal directly with State Farm and you guys read him the riot act. Thanks for all the quoted CA law but he lives in FL and it may not apply to him. Besides there was a police report thus it has been reported to the state which will report it to DMV.
State Farm plain and simple sucks. They fucked Hurricane Andrew victims then again this and last year are fucking Hurricane Katrina victims. They have engineering reports from Mississippi and Louisiana that said that the majority of structural damage to homes was caused by wind damage (covered under a homeowner policy) and not storm surge (not covered). State Farm sent these reports back to the engineering firm and said that this isn't right change them to majority damage by storm surge (so they do not have to pay out) or we will not pay you for the engineering reports. There are two employees of State Farm in Mississippi that have quit and blown the whistle. There are engineers that say that is not the report I filled out, that is not my signature on that report and I determined it was wind damage that caused the homes failure (which is covered) and not storm surge. |
I have used state farm in the past and had no problems but i never really cared for them
i have dealt w/ insurance companies directly before when i was rear ended as well. it was american family insurance and it went through smoothly. told me to take it to the ford dealer or any body shop of my choice and they will send someone out from claims to take pictures before the repairs are made and to setup payment arangement w/ the repair facility. also got me in a rental that day. all went smoothly.. when my policy w/ state farm came up for renewl i decided screw it and switched to american family which was cheaper anyway.. |
