TheSenator 08-16-2006 12:52 PM

Content producer = primary
webmaster = secondary

hire model = primary
buy content = secondary

Shoehorn! 08-16-2006 11:30 PM

I hope they have everything in order.

Not that simple.
They buy content, edit it togeather and sell it.
Webmaster buys content, edits the pis/vids to his liking and sells it.

It also said they produce "mostly compilation titles"

I'd like to know which records they where interested in.

Dagwolf 08-16-2006 11:41 PM

It's got to suck to be operating in the U.S. right now.

notabook 08-16-2006 11:41 PM

Thank god for 2257! Just last night on Fox News on there, a reformed pedophile. He was talking with that total train wreck of a woman Greta Van Susteren about how he used to sexually stalk young girls in AOL chatrooms. Then about a month ago he messages one for naked pics and she sent back "sorry, no 2257 LOL!" and he got all sad and realized he should stop raping kids. True story.

nastynun 08-16-2006 11:42 PM

The term "secondary producer" never existed in Section 2257 and is not found in the recently amended statute, either. Instead, Congress has included the persons who insert images depicting actual, explicit sex and those who digitize them with a commercial interest into the expanded definition of the persons who "produce" such conduct. Congress has clearly legislated that secondary producers are, indeed, producers. The obligations of the law affect them as much as the guy behind the lens, assuming the constitutionality of the Statute. It is now clear that licensing/assignee webmasters must maintain the records and content, publish the notice, categorize the records, and make them available for inspection.

But there is no comparable provision for 2257. So, we can expect that the government will argue that records must be created and maintained for ?lascivious display? images created on or after July 28, 2006. We can also expect the government to argue that secondary producers must keep records from that day forward. Remember, though, the government may argue that secondary producers should have been keeping the required records all along. (FSC will, of course, oppose all of these arguments. See answers below).

This is the real problem - not us. They are going after "pornographers" and the headlines instead of attempting to do anything real.

Aye! Exactly my point... 2257 does nothing to protect the kids, it's absolutely a ridiculous waste of tax payer's money for the legislation. The majority of adult webmasters plaster their pages with adult only, with entrance pages, making every possible attempt to let people know HEY SHITHEADS, ADULT ONLY HERE! yet adult webmasters are always the ones getting shit on the most... I just fucking don't understand it, I guess we can just chop it up to the religious right again but come on, nobody tries to protect the kids MORE than the adult porn business!

Now now, don't go and actually post links to what's really gone down...

I'm shocked to not hear a lot more noise about this from big sponsors out there as this potentially quashes much of their 'affiliate' pushing base's ability to stay in the biz.

Maybe they're keeping quiet and battening down the hatches themselves?

hmmm

scottybuzz 08-16-2006 11:56 PM

welcome to persecution, we arent the first group to experience it, nor will be the last

Good questions Jimmy...Since Congress has clearly legislated that secondary producers are, indeed, producers. So how shall "secondary producers" go about getting the proper records(documents) from the affiliate programs since we use their banners, photos(content) etc to promote them?

It's sort of obvious that we have to keep records as of July 27th look at the inspections going on since then?

Well actually I'm glad I made the decision to host no nude or sexually explicit content as of 5 years or so ago now...

Clothed and tease images work fine for conversions over here...

(Well except with one cam sponsor lately LOL!)

Firehorse 08-17-2006 12:15 AM

The government and the word clusterfuck go together too well.

I am sure we will see much more of this. :(

Oh I don't know, get to see lots of pictures and videos of naked females getting it on, and less risk of being shot or at/blown up.

I'm guessing you've never met an FBI agent. You must be thinking of MI6.

Don't know if any of you are following the story of Jeff Myers, it's on Porn City and Pimp Board.

If you are then are you suggesting it's a good idea to leave the record keeping to a guy like this?

Seems he has now scammed a sponsor and disappeared. He found God. This was after the police found him with a drunk 17 year old in his bed, accused him of giving models Ecstasy and trawling for models on Myspace.

Just the kind of guy I want holding the records to keep my arse out of jail.

NOT!!!!

You might know Jeff as Perfection Jeff, he scammed people and models under that name and then Shooting_Maniac when he came back after the controversy.

Totally agree !!

Heres a crazy idea, Why not make the parents responsible for their kids !!! Instead of trying to blame it all the problems of society on pornographers !

Sometimes I wonder how they come up with some of the shit they do, claiming bullshit like sex = violence ! Its just insane !

One thing I do not like is the increasing trend I'm seeing on the news that is reporting that anyone who disagrees with the governments official statements is a terrorist :Oh crap

The Nazis pulled that kinda of shit within their own propaganda

Just think of the term " Patriot " act ....

If you are not in agreement, well you are "unpatriotic" , so basically a traitor ...
This is exactly how the nazis did it ....

They could have called it the " SECURITY " or " PREVENTION" or whatever .... act...
