HOW DOES THIS SITE GET AWAY WITH IT-bearchive.com

It has been in existence for five or six years. Its a morphing site, which has it so called "artists" steal content form sites like Scoreland and such boob sites, manipulate pixles so the tits look like boulders, then store them in their galleries which one has to pay to see.

Any other person who stole such images would be threatened rather quickly by Scoreland's henchmen.

They'll only complain when someone figures out how to enter these guys sites into bearshare and starts ripping them. :1orglaugh

THEN you will see an uproar.

Based on my knowledge of copyright law (but I'm not an attorney), it's probably legal. There are a few loopholes in copyright law, one of them being "parody." I suspect they'd use the "I was making fun of..." defense.

Gemini 06-15-2002 07:45 PM

p2p... person 2 person.... peer 2 peer... depends on who is answering that question but it all comes out the same Cappy... THIEVES :winkwink:

Cappy Canucklehead 06-15-2002 07:53 PM

And heres the real kicker-the editor in chief of the Scoreland mag posts in their forum regularly, asking the thieves if they would be so kind as to leave the Scoreland logo on the pix as they are posted into the site's free User Gallery.

I have a classified ad for one of my sites on a non-adult site where they can comment on your ads. All they mention is the TGPs & Kaaza for free porn....and that there's no need to pull out plastic cuz they can get all the FREE shit they need to bust a nut. It really makes ya feel like all your hard work is paying off (enter sarcasm HERE!).:321GFY

Ummm is this posted in the wrong thread? What does this have to do with the thread topic?

Why is it when someone is ostracized from one group for being a complete and utter prick, that they must find somewhere else to go a bitch?

Oh, hi Cappy.

I do find it ironic that Cappy is complaining about something he himself has participated in (by making several sites ... that all failed).

I believe the official Zen answer in this case is: Mu, unask the question (ie, you are asking the wrong question ... ie, instead of asking what is wrong with the BEA, maybe you should start on a more personal level).

For a reality twist in which this forum post is discussed over there, visit here: http://forum.bearchive.com/showflat.php?Cat=&Board=UBB1&Number=31775&page=0&v iew=collapsed&sb=5&o=0&fpart=

But don't expect the post to last for very long ... Cappy posts tend to be deleted for everyone's sanity.

Copyright law protects "transformative" work as fair us.

I take pic of JennaJ, shrink her head, and they can't touch me. Espeically if it's artistic. There was a thread in A W I (sorry) about a recent ruling that even said that thumbnailing a pic was a transformative process, since when re-enlarged it no longer resembles the original work. However, he failed to put any absolute restraints on it.

So, technically right now, you drop the size of a pic 1 pixel, you can use it within the law. Of course when your case goes to court, they will find against you, and re-write the law, but at very least I think you are sheltered from punitive dmgs.

So, um... yea, copyright law is FUCKED right now... not much you can do about it. It's vague, every judge has a different opinion, but it's impossible..

Sure if I put a solarize filter on a pic, or add a sandstone texture and make it black and white, it's been transformed, and therefore may be considered art, however, how much does the sandstone have to show, What exact filters, with what exact settings will constitute a transformative process is entirely up in the air, and hard to set boundries on.
