Can Spam Update from AdultLaw.com
In yet another disturbing case by the DOJ, TJ Web settled with the gov't and paid an undisclosed amount of cash as well as agreeing to terms with the gov't. Those terms, accroding to a June 28, 2006 Order by the Court, have been sealed and remain undisclosed.
Continuing to cowtow to the DOJ, unless you are dead on guilty, will only encourage them to continue to file suits and come with their hands out. The most disturbing aspect of this is that the law regarding liability for affiliate actions and those acts of third parties has not been settled because only one company to date is fighting, to wit, Cyberheat with their Lawyer from AdultLaw.com, Robert Apgood.
The first round of Summary Judgment Motions has been filed with the Court and oral argument is scheduled for December 2006. This decision will have repercussions for all. We are also seeing the beginnings of copy-cat private Can-Spam suits by individuals against Affiliate programs. The money grab has begun. If you don't fight, we all pay.
