2257 Document Question...

Okay... Call me dumb, but I always thought the only required documents for 2257 compliance was signed model releases and proof of age. Now I'm hearing I need more than that, but I can't find a good resource that describes the requirements in details. Anyone got a good link or simply break it down for me?

L-Pink 07-31-2006 11:19 PM

GFY search or google .....

I found about 50,000 pages of "make sure you have your documents in order", but nothing that actually explains what documents beyond model release and proof of age are required.

BIGTYMER 07-31-2006 11:25 PM

You mean you don't have DNA samples on all your models?!?!

It sounds like you have MUCH work ahead of you.

The documents themselves are the easy part...

Good luck!

This kind of retarded answer is EXACTLY why you fuckers need to cough up some dough and talk to a real lawyer who knows this shit instead of getting your legal knowledge from a message board.

Probably one day.

I saw a real fucked up thing on TV. Not sure what city it was, but to get in a dance club you had have your fingerprint digitally scanned. Then if you cause trouble in the club they log it in the database that is shared by all the clubs in this city. So once you're labeled a troublemaker you can't get in any other nightclub.

Kindly direct me to where, in 2257, it mentions anything about a require model release.

I'll be standing by...holding my breath.

I have a lawyer that specializes in just this actually. My problem was that all the recent talk, brought on by the infamous inspections, gave me the idea I was given bad advice. It turns out I'm completely within compliance. It's not so much the number of documents involved as it is the information required on those documents.

Excuse me for double checking... :321GFY

If I'm not mistaken filing your model release with your 2257 docs is "improper record-keeping" Up to five yrs. in the pokey .....

You = full of shit.

It has been reported that 95% of this industry is not compliant. It should go without saying that the few who are in the 5% would not be posting threads like this on GFY.

You make too many assumptions. You think only a high profile affiliate site is capable of compliance? You are exceptionally ignorant.

Required:
a. Date of Birth
b. Legal Name
c. All other names, aliases, nick names, stage names, and maiden names
d. Social Security Number
e. Copy of Government-Issued Identification containing a picture
f. Address, phone and other contact information
g. The model's signature

The forms I use include all of this and more. I'm compliant.

3 of those are not requirements.

STFU if you don't know what you are talking about.

Copied and Pasted directly from a First Amendment Attorney's site. I think I'll take his word over yours.

Copied and Pasted directly from 18 USC Section 2257.

"(1) The legal name and date of birth of each performer, obtained by the producer's examination of an identification document, as defined by 18 U.S.C. 1028(d). For any performer portrayed in such a depiction made after May 26, 1992, the records shall also include a legible copy of the identification document examined and, if that document does not contain a recent and recognizable picture of the performer, a legible copy of a picture identification card.
(2) Any name, other than each performer's legal name, ever used by the performer, including the performer's maiden name, alias, nickname, stage name, or professional name. For any performer portrayed in such a depiction made after May 26, 1992, such names shall be indexed by the title or identifying number of the book, magazine, film, videotape, or other matter.
(b) A producer who is a secondary producer as defined in Sec. 75.1(c) may satisfy the requirements of this part to create and maintain records by accepting from the primary producer, as defined in Sec. 75.1(c), copies of the records described in paragraph (a) of this section. Such a secondary producer shall also keep records of the name and address of the primary producer from whom he received copies of the records.
(c) The information contained in the records required to be created and maintained by this part need be current only as of the time the primary producer actually films, videotapes, or photographs the visual depiction of actual sexually explicit conduct. If the producer subsequently produces an additional book, magazine, film, videotape or other matter that contains one or more visual depictions of actual sexually explicit conduct made by a performer for whom he maintains records as required by this part, the producer may add the additional title and/or identifying number and the names of the performer to the existing records maintained pursuant to Sec. 5.2(a)(2).

Just because your attorney suggests you have it does not mean it is required by law. I think I'll take the DOJ's word over yours.

AaronM 08-01-2006 01:00 AM

BTW Condor...How many 2257 panels have you been invited to speak on?

I think the word you're looking for is "fake" unless "fack" is supposed to be the punch line to some sort of clever joke or something.

My balls function just fine buddy and my name is every bit as genuine as the moniker "Aaron Matthews", but lets forget all that for a moment. The man asked a civil question, why did you feel so compelled to come off like an asshole? I mean really, did the gerbil bite on the way in or what?

Thank you for correcting my typo.

In case you missed it, this place is called GoFuckYourself. This is where I come to vent about whatever is on my mind. When I read GFY, the thing that is most often on my mind is how dumb most people are. Now, being the straight forward shooter that I am, I feel exceedingly compelled to point out the continuous and contagious stupidity of others.

Does that make me an asshole? You bet it does. And ya know what? I'm OK with that because those who matter to me either know I am right or don't give a fuck what I post on a message board as long as I respect and support them.

Gilster 08-01-2006 07:52 AM

Yikes. Aaron is right, if cranky. There are plenty of things like model releases and contact info that are useful but not required under 2257. Some in a defense to 2257 prosecution. But if it's not required by 2257 best not include it as part of the 2257 database -- not unless you want the FBI to snork it up in process of a 2257 inspection.

DWB 08-01-2006 08:57 AM

what is this 2257 everyone speaks of? hits or page views? please explain.

Manowar 08-01-2006 08:59 AM

search GFY
