BETHLEHEM, Pa. ? Amateur gay producer Sebastian Sloane Productions was the target of a second investigation over 2257 records that apparently is spreading nationwide.

Sole proprietor JJ Ruch told XBIZ that four FBI agents Friday morning arrived at his two-story Bethlehem house, where he also operates his business.

?They arrived in a big black SUV with government license plates, got out of the car and knocked at the door,? Ruch said. ?Once I opened the door, they moved forward inside and said, ?We?ll do the search ourselves.?

Agents searched his home office, as well as other parts of his home including closets and kitchen cupboards and a basement, for nearly four and one-half hours. Ruch said that they even looked through his video camera viewfinder in their search for images of underage models.

?They took photos of all of the model releases with a small electronic device,? said Ruch, who noted that he has had 136 models working for his company in its 1-year existence.

Ruch, who started Sebastian Sloane Productions last year in San Diego, Calif., and later moved his operation to Bethlehem, has produced eight videos, with an additional 28 in the editing phase. His company, which films bareback and safe-sex scenes, also distributes content on 124 sites.

The investigation of Sebastian Sloane Productions is the second in a week over 18 U.S.C. §2257. The FBI visited the Chatsworth, Calif., office of Diabolic Video on Monday to check their records.

Diabolic reportedly passed its inspection, and Ruch said agents told him he passed their probe for tidy records and images of underage models as well.

?My model-release form is quite lengthy ? 18 pages, in fact,? Ruch said. ?Before I started my business, I consulted with an attorney on what kind of release I should use.

?I?ve always kept the books in line just because of the possibilities of an investigation like this. The agents said they?ve compiled two years worth of research on the adult industry, using Whois and reviewing video-on-demand sites to see who's producing what.?

Ruch said agents told him that there are 16 FBI four-member teams nationwide that are searching adult producers and secondary producers.

?It is kind of intimidating when they?re four of them at your door,? he said. ?They?re quite demanding, and they stood their ground.?

My understanding is that the scope of the inspection is supposed to be very narrow, and is to be focused solely on the 2257 records alone (not model releases, nor anything else).

I would ask the agents/inspectors to show me where in the 2257 law it indicates that they have a right to search anything besides the 2257 info that I am required to turn over to them for inspection, and if that can't show this to me (since it doesn;t exist), then I would respectfully decline their request to invade my privacy, my private property, and otherwise trample over my rights.

That is why it is important to keep your 2257 documents organized in one place and seperated from any other documents.

Try as the Governemnt might to erode our rights (instead of protect and preserve them), we still do have rights and should exercise them.

"I wasn't going to let them go through anything with out some sort of warrant to search. They had shown me a search warrant for a search and seize of the property. They said this is a standard investigation that they're doing it with all companies that produce pornographic materials."

This is from the text of the law...

It sounds like they went beyond the scope defined by the law, unless their warrant granted more than a simple 2257 inspection. He should have been able to obtain or make a copy of the warrant, since it should have spelled out what the grounds were for searching his entire premises, and not just inspecting and copying his 2257 records.

There may be more to his case than simply 2257 compliance...

Yes, they would immedietly. Our consitution says that searches can only be performed with warrents, and that the warrents must detail exactly what they're looking for and they can only use the search in relation to what is listed in the warrent, but, our consitution is pretty much just for show at this point. If they found one gram of cocaine that dude would be in jail for years.

If you have nothing to hide, allowing them to search the rest of your house isn't an issue - except that without a warrant, they really shouldn't be able to do it... unless he has used the rest of the house as a set for his shoots, which would make it hard to tell home from office. Another amazingly good reason to have an actual office rather than a home office.

he said they had a warrant to search and seize property. i'm no law student or lawyer, but i believe that means they had to go to the judge and make a case for getting a warrant and demonstrate good cause... and the judge had to agree.
