Probably not, because they do moderate the media - they manually remove spam, they recategorize content, they delete obviously illegal material like beasty and CP.
You only get the exclusion when there is no reasonable expectation that a provider can moderate the content, as with a service provider, information retrieval service or self-publishing platform (the providers of services like blogspot or thumblogger.com). |
They aren't primary producer's. Maybe they are FSC members and exempt from inspection.

GUBA is just paid access to newsgroups. There are 100's of such services that opperate the same way GUBA does. It's just that GFY has a hardon for only GUBA.
