The authorities (if you wanna call them that) have set this thing up like they were after a drug ring (I know all about those :winkwink:)

They've got a confidential informant (snitch) who basically helped them build their whole case this snitch has revealed that she was paid to have sex at a private party prior to being filmed...

I would hate to be these guys right now...

I think everyone knows what is wrong with paying for sex, it's called prostitution, and I'm pretty sure that EVERYONE knows that it is illegal nationwide. (with the exception of parts of NV or whatever)

I believe the problem here is the fact that they were producing content in that area, which is illegal, I do believe. In fact I think I read that the entire US is in a grey area as far as the production of adult content goes...except CA, parts of it (or perhaps all) of Cali are OK to produce in. (Correct me if I'm wrong.)

I hear a lot of sponsors produce in FL though, and I'm keepin my fingers crossed that they don't have the same problems as Ray Guhn...:Oh crap

Lastly, I don't have the link, but there is another thread on this that I suggest EVERYONE read, as it clears up several issues dealing with the legality of producing adult material.

Same as all cases - there are peripheral things, which may or may not be used later - and depending, can be open to serving a defense well.

Smell till they finish their investigation and arrest any other folks and the dust settles, it really means not a lot right now. Once the hype of the moment subsides - it's a new day and time to attack :)

Yeah I hear what you're saying....but then again most of these frightning
new laws concern almost every individual in your country....not just adult
webmasters. I understand that just moving is an option for everybody aswell.
I hope that people start to realise soon what's going on with the most
valuable right they posses.....FREEDOM and make a wise decision at the
next elections.

Don't get me wrong I have nothing against Americans in general your country
has a lot of good things. It just amazes me that with all that is happening
most people either don't realise the consequences of it or they are just
accepting it.....it's like watching a movie really. Soon a great movie comes
out.....it's called America: From freedom to Fascism. I'm not claiming that

Depending on the circumstances, the procurement of persons to perform in such works will constitute the crimes of pimping or pandering. So how are thousands of porn shoots legally conducted in California each year? The answer can be found in one case, People v. Freeman, 250 Cal.Rptr. 589 (Cal. 1988).

In the Freeman case, the California Supreme Court held that ?in order to constitute prostitution, the money or other consideration must be paid for the purpose of sexual arousal or gratification.? 250 Cal.Rptr., at 600. The court characterized the payments made to the performers as ?acting fees? and held that ?there is no evidence that [ Freeman] paid the acting fees for the purposes of sexual arousal or gratification, his own or the actors.'? Id. Thus, the court held that Freeman ?did not engage in either the requisite conduct nor did he have the requisite [intent] or purpose to establish procurement for purposes of prostitution.? Ibid. In fact, the court said that ?even if [Freeman?s] conduct could somehow be found to come within the definition of ?prostitution? literally, the application of the pandering statute to the hiring of actors to perform in the production of a non-obscene motion picture would impinge unconstitutionally upon First Amendment values.? Ibid.

The California Supreme Court?s ruling paved the way for today?s multibillion-dollar international adult video industry centered in the San Fernando Valley. Unfortunately, so far no other state?s high court has adopted the California Supreme Court?s sound reasoning and the Freeman case is only legally binding law in California.

Producing porn in Florida is iffy, but seemingly safe in south Florida (Dade and Broward counties), but producing porn in Escambia county where it's damn near illegal to spit in public, was just plain dumb.

when i was in pensacola. i was eating at a restaurant, alone. and i was listening to the table next to mines conversation(call me a bastard, whatever) but it was rather interesting it was a bunch of cops. they were talking about beating 'hahahahahahas' and shit. they sure seemed to get a kick out of beating people in that town. they were talking about how they planned to beat a guy to death, but he passed out and went limp first. made me scared to ever go back there.
