They don't own it, they just have a license to use it. You still own it. There is no transfer of rights in that paragraph.

ok, sorry, i worded that wrong.....basically, if you post content there, they have a license to use it for whatever they want

so, if nine inch nails posted a new song of theirs on that site, myspace has the rights to use that song however they see fit

well, i doubt that myspace will be using any porn pictures any time soon, this mainly pertains to the millions of musicians that have their songs posted on there

Think so, but interesting question at law. They could say Nine Inch Nails posted this song at MySpace.com and here it is I guess?? Any tallent would include a Copyright Statement with their posting, so it really is a question? Where's the GFY lawyers?

sounds like something they'd put in their TOS to try and sneak by ya, but if a star found their content being used in another way because myspace acts like they own it, they'd get that part shot down and their TOS would have to change. i'm guessing no one's challenged it yet, right?

I seriously doubt that myspace would pull any shady shit, so I doubt that it would ever need to be taken to court, but it is still an interesting thing to put in the TOS, and from what people are saying it hasn't always been there, only since fox bought the myspace parent company

Legally, I suppose that is true. Just to be in business the way they are they really need that paragraph. Most companies would not abuse the license in a way that would then inhibit people from using the service in the future.
