JimTheFiend's thread reminded me of this...

Two years ago my house got broken into while I was there. Long story, but basically these two big guys broke down my door and smashed my face in with hammers and beat the hell out of me. This was no fight. They completely beat me to a bloody, crawling pulp using hammers on my face and chest. I couldn't see or walk for about an hour, and had trouble seeing, talking and eating for about a week afterwards.

They get charged with Simple Assault.
I would think it would be Assualt with a Deadly Weapon (?) or something a bit more severe, but no.

Does this seem Just to you?

It is in every state in the Union. Basically any object other than ones hands is considered to be a weapon.

if any foriegn object is used in an assult with the purpose of creating major injury or harm it can go from either falonious assult to attempted murder but the attempted murder would be hard to prove... simple assult No.. you can use anything if I stabbed you with a pencil that

I had a girl tell the police that I hit her with one of those metal rebar things that go into the street and they charged me with " felonious assult with attempt to harm" which got dropped..

its the d.a. who decides what charges to lay , the police may submit a number of charges and the d.a. may only move on some of them..

There could be other factors at play, maybe they lost the hammer in evidence or fucked up the paperwork and figured if we get him to plead to a lesser charge he wont get off scot free

I didn't go there because

if there's medical records to prove injuries, and the weapons were recovered, then it should've been a bigger charge. unless they decided to plead guilty to a lesser offense.
