My Dvd's are being sold thru a magazine
 
My Dvd's are being sold thru a magazine with out my permission. The prick thats selling them is using a P.O. BOX for mail in orders, what can I do to stop this.

First:a cease and desist so that he cannot claim further along that he din't know or bought them from somebody else.

After ( because he will ignore your previous notification ) get a lawyer. He will know what to do.

Don't you get the feds or other cops involved. Let the lawyer do that ...:2 cents:

If he is using your images in the magazines, he is violating your copyright... It is easier with this route ... Send a cease and decist to the magazine also, letting them know that they are reproducing images that they do not own or don't have a legit authorisation to do so... Magazine will back out in a jiffy..

Also, if the guy reproduces your images for a DVD cover or cover disc, you will get him there .

Yeah they are using 14 dvd box covers in the magazine ad.

If you're distributing or wholesaling, it's very possible that someone you sold to may have had overstock and resold to this guy.

The other possibility is that there's been more than one DVD replication plant (at least one in the LA area) that were caught producing double the quantity of discs that were ordered by the customer. In one case, the customer discovered it because the plant screwed up and shipped the full quantity to the customer, then shipped another 800 units to one of the customer's retailers.

Couple thoughts:

-- If any of the images on the DVD covers reproduced in the magazine are sexually explicit, try telling the magazine that since the discs are not yours, there's no 2257 documentation behind them (i.e., you won't supply it.) That should be enough to make the magazine shit bricks.

-- If the DVDs are registered with the copyright office, statutory copyright infringement is something like $25,000 per infringement.

-- I would definitely order one of the videos and see what you get. If it looks legit, you most likely have a pirating problem (perhaps with your replication house) unless it's possible the guy bought 'em as overstock as I said above.

C&D to both the individual and magazine.

Get your lawyer on the case to follow up on any money/civl action.

FBI is last resort, and your lawyer will make that call. In the US most cases would never need to get that far.

once again, have you ordered them from him to verify he's selling bootlegs? if you're sure he is ripping, then order anyway using another address or POBOX so you have tangible proof that he is doing what you claim.

if in fact someone is actually making new covers, then yes, but I looked over the thread and didn't see the thread starter saying that anywhere

is there some place on your website that says the dvd's can't be resold?

Are they being sold through the mail or shipped via UPS? If it's through the USPS, then you break Federal laws as well. Go to the post office, talk to the postmaster, ask them to set up a sting where you buy a copy and have it sent to a PO box.

yeah, but I can buy a shitload of vivid dvd's and advertise that I am selling them as a retail outlet....there is nothing wrong with that, that is why they sell them wholesale. I do that now in fact, I have a wholesale account with multiple studios and I have a online shop setup that I sell their dvd's from...i use their boxcovers in the shop, am I breaking any rules? nope...

like I said, I think there is way more to this story
