I don't think they should be allowed to use generic words that way in the first place. If you use a generic word for your company, you should be forced to waive the right to sue another company later who wants to use a generic word too. Maybe that's a little more extreme, but you get the idea.
Like if they want to call their company 'Company', they have to deal with it all the others who use it too. |
