So me and my gf bought a house/apartment, BUT...

... the old farts that are living there now has no intention on moving out. Wtf... They haven't found anything new yet, and it looks like we must wait like OVER 3-4 months! This sucks... :(

Is there anything we can do? :helpme

Jensen 04-25-2006 04:04 AM

ooooooooooooookey.. thats shitty.. what does the sales contract say about that?

Dirty F 04-25-2006 04:06 AM

Dude, you signed a contract. Read what it says and kick them the fuck out if you can.

You in a rush to move in?

Bit of an arse, but if the papers are signed over you can kick them out!

Post pics of the new place and good luck with the move!

They have 3 months to find something new. After that, we can abort the buying, but we are not interested in that... we just want the fucking apartment lol.

ssp 04-25-2006 04:12 AM

Seems like you have to put your foot down...

Sexsitesurfer 04-25-2006 04:18 AM

Should have stipulated something in the original contract before agreeing to sign... Oh well, fingers crossed they are out quick!

What city / state are you in?
Did you "officially" close on the property yet?

If you already closed on it, and it doesn't specifically state they get to stay there, etc. have them served with a 30 day notice (this is assuming you have already officially closed and your contract didn't state anything else regarding them staying).

If your contract did state they could stay in there, who is making the mortgage payment while they're there?

However, I'm getting ahead of myself here without knowing the answers to the first two questions...

Pay their neighbors a visit. Spot them some cash to let you have a party there. Bring some really big speakers and some really aggressive death metal. Play as loud as possible. Problem solved.

there are no ghettos in Europe

if you own the property you can put them up in a hotel / other living arangments until they find what they are looking for ( first agree on an amount of time to pay for them )

I want to do biz with you! The kind of person that is too stupid to read a contract haha!

L-Pink 04-25-2006 06:57 AM

Ask the lawyer that reviewed your paperwork. The one that explained the fine-points of where you stood before buying part of a multi-owner building, dumbass.

I know, that's why I said highly inaccurate. He said Europe, not Norway. :)

DanielS 04-25-2006 07:13 AM

You should pay ONLY when they give you the key, not before. You should check with a lawyer. Didn't you read the contract before signing?

HuH? He said he bought an apartment. He doesn't know when he can legally move in. Based on that he obviously didn't have a lawyer review before closing.

So he also probably doesn't know his legal position if .....

The building needs a new roof shortly after moving in ....
Someone's plumbing fails and ruins another unit ....
Fire partially or completely ruins the building ....
A guest is injured on common property and sues the whole building ....
Is a special umbrella insurance policy needed ....
Etc, etc .....

Buying part or a percentage of something is very different than owning all of it.

ServerGenius 04-25-2006 07:52 AM

I can get them out within 5 minutes......$5K plus expenses:thumbsup
and since you're a soft C.U.N.T I'll guarantee I will use intimidation as my weapon only......no grannies will get molested during or after the process :winkwink:

LexiLexxx 04-25-2006 07:56 AM

Do you know any of their family members?

If you could contact them, that may help....

Being that old, means moving is a huge issue.

I hope all works out, but I always have a soft spot for the elderly.

What he said was the they have 3 months to move. Thats pretty standard and normal. Every property has been inspected before sale up here and a status report is included with the paperwork in viewings. Don't know how other countries handles that though...

Sosa 04-25-2006 08:40 AM

wtf? did you actually close on the house, is it in your name now? If so kick them the fuck out.

The inspection doesn't spell-out his obligations or liability as a partial owner. If 3 months is standard WTF is his post about?

pretty standard to wait a few months before moving in.. buyers normally have clauses about financial stuff and sellers about finding a new place etc.. don't know how this is over at you guys though...

Jensen he actually said ..... "They have 3 months to find something new. After that, we can abort the buying, but we are not interested in that... we just want the fucking apartment lol."

These people can actually NEVER move, all he can do is cancell the deal after wasting 3 months? I stand behind my "dumbass" comment.
