if you ask the police to leave your propety, do they have to? Trying to google this but its coming up with other crap.

I had an incident last night where the cops were on my property, spying through my windows, and a bunch of other crap. I told them to leave and they wouldn't.

Depends on why they were there. If they had reason to be on your property, there isn't much you can do.

what were you doing prior to them arriving and peeping? did they not come to the door first?

Yeah, neighbors called the cops cause I had about 25 people over being pretty loud. The thing is, after they left, I had 3 friends staying here(cause they were very very drunk) and the cops kept saying I had to make them go home too. I told them to screw off cause I wasn't making my friends drive home drunk. The cops then spied through the windows and said I wasn't complying. They sat out in my drive and yelled saying they were gonna take my car (which I know isn't legal).

They kept yelling, "we are taking your escalade, we are taking your escalade" lol. I didn't respond to them or say anything. But I got another ticket for "failer to comply".

Yes, they need a reason.

It's usually called "probable cause" if it is in connection to a crime being committed.

It they are going to enter your home at some later point, they need a search warrant.

Well the thing is, the lawyer is going to cost more than the ticket probably will, but I don't want to take this like a bitch. So im going to try and research it all myself and represent myself in court.

They need to have a warrent to come on your property and stay after you ask them to leave, or they need exigent circumstances. I.e. if they hear a woman screaming for help, they have probable cause to belive that someone's life may be in danager and they can enter your property without waiting for a warrent.

And it dosent matter if you ask them nicely. People have rights and they are perfectly within thier rights to excercise them. I had an FBI agent come out to my place once trying to snoop around and he wanted to come in and talk to me about some things I had said online about Bush. He didnt really wait for me to answer his question about coming in and tried to sorta step by me into the house and I said "No, we can talk out here just fine" and I blocked the doorway with my girth and shut the door behind me. Some people consider this extrodinarily rude, but I dont really care. He had no business in my home and since he didnt have a warrent (I didnt even have to ask, as he would have volunteered this information when I tried to shut the door on him) he wasnt going in.

Get a lawyer and sue them. It sounds like they stepped over the line.

Yeah, they definatly crossed the line. I feel pretty violated, and am pissed that they would even say they are going to take my suv.

depends on the city.. in some places if the police have reason to believe that there is underage drinking going on... they can just enter the house. i've seen it done before.

Realistically, they had probable cause to be on your property. A noise complaint is enough to get them there. To get them inside the house, the need additional PC. Either possible drug use (smells or paraphrenalia) or possible underage drinking. That...or you letting them in. The guy above talking about the FBI agent just starting to walk in is typical. A smart cop (I know, I used to be one) invites himself in. If you don't stop him, you invited him in and now he's free to "observe" whatever he can and thereby you've given him PC to search your house, etc.

As far as them sitting in your yard yelling about taking your car, I would've called 911, demanded that a supervisor be sent to my house immediately and then thrown a royal bitch fit. It's completely unnecessary and childish for them to do that. If what you described above (which was a bit short and non-detailed) is all that happened, they had no reason to be sitting in your yard threatening, but then again you had no reason not to be in your yard talking to them like an adult.

Nah. It's not rude. I've done the same thing when the cops come to talk to me about something. They try and walk in the door, and I always have my door cracked, with my foot behind it to prevent someone just walking in when I answer it.

I do not drink or do drugs, and there is nothing in my place that would get me in trouble. But by the same token, I do not need them coming into my place for any reason. They can either talk through the door, or I will come outside.

I've also had police who wanted to talk to me in the back of their car when they came to my place, and I refused that as well. They can talk to me standing there, or I will sit in my truck. Which I did. I answered all questions yes/no and when he started to get huffy, I provided my lawyer's name and number to call on Monday.

As for your property issue, I believe they have to leave unless they have probable cause that something illegals going on. I would double check that with a lawyer, or state law just to make sure. I dunno if I would go on to sue unless it because a constant annoyance.

I was going to call 911 but my friends stopped me. I did call dispatch and told the lady what was going on and she said I was being rude. She then put me through to the officer, I told him I wanted his name and number so my lawyer could contact them. He said he wouldn't speak to my lawyer if he called and he hung up on me. He didn't give me his name either, but it is on the ticket I got.

I didn't go outside because I didn't want to get public intoxication. They were being complete assholes so I know they would have grabbed me.

I guess its the same in any country - if they had cause to be there theyre allowed. You can deny entrance etc but offcourse it doesnt make them happy if you do that.

Well what the cops did was illegal in your situation. Although they had probably cause to look around, they had no right to demand people to leave or to say they would take your car. It is a clear case of harrasment as well as having your civil rights violated.

The problem is that the police really have no checks and balances. You can take them to court and they will just lie through their teeth and say it never happened. It sucks, but it's the society we live in.

if they either have a warrant or you property was a crime scene they indeed have a business to be there
