Ive got a guns question [educate me pls]
 
Ok so Im wathcing this MTV special bout guns good bad etc. Theres one thing I dont understand. As you prolly know guns are illegal in Holland, so that makes it easy. Have one, no permit (and you basically cant get it unless youre a cop) and youre doin time. Course you can get them illegally here. But Im talkin legal.

In the US you can get a gun, own one, a rifle even, but this guy who had a machine gun on him got arrested. Then again this 19yo college girl carried one along in her purse, dummy bullets though, real gun.

So you need some kinda permit to have one I guess? See I thought bout this since I saw the PHX pics the shooting in the desert, didnt go there, but thats legal I assume, how does that work?

Most states in the US have different laws. Whether you need permit to buy or not. All states to require a back ground check to purchase a gun. Some states you are capable of carrying a conceled weapon with a permit from the state(or a state that has reciprocity with that state).

Yes, our Constitution guarantess us the right to keep and bear arms. As long as you're not a convicted felon in most states it's just a simple background check. Carrying is a completely different issue, while some states (here in the south) allow you to carry if you have a permit, other states are much stricter. In TN I can carry my handgun locked and loaded under my jacket with no problems because I have a concealed carry permit, but when I go to CA it has to be unloaded and unaccessible. STUPID if you ask me, what good is an unloaded gun in the trunk.

our laws here are wack.. in california you can own pretty much all the weapons you want. as long as they aren't automatic machine guns, assault rifles, and probably 50 cal's. now while you can own them you can't carry them in public unless you have a special permit which in my county is ridiculously hard to get. so anytime you transport rifles/shotguns to anywhere they must be unloaded and in the trunk of your car. if its a pistol you must have it unloaded, in a locked gun box, and in the trunk.

i think the only acceptions to any of those laws are when your hunting up in the mountains. other then that it varies from state to state. :thumbsup

There are Federal AND State laws ... So generally speaking,

Certain guns and accessories need Federal permits. (machine guns and silencers)

States ... some prohibit ANY possesion or carrying without permits ... some require the gun to be carried openly unless you have a concealed carry permit. Example. Legally I can strap-on a pistol and holster old west style and walk down my street. If I put on a coat that covers the gun I have broken the law unless I have a concealed carry permit.

Some states allow open carry, others, such as Pennsylvania -- I'm told I can carry open (not concealed at all) and it's legal, but the cops will harrass you for it, since everyone will be calling the cops because "some guy has a gun!"

I have my permit to carry -- basically can't carry in government buildings, schools and anywhere that serves alcohol. I may be forgetting some, but it's too easy to get a permit in PA.

Same in WA. I was actually surprised how easy it is to get one. You dont even have to take a gun safty course. You just need a 2 day waiting period and a background check. Also anyone can carry a concealed weapon if they have a permit. In michigan where i am from you have to give a reason why you need to conceal it (ie off duty cop or security)

Im all for guns I just think if you are gonna have one you should at least be made to take a gun safety course..

k thanks all lot clearer to me now, so basically its ok to have one, no automatic ones, but cant keep it loaded in your hand

so why is it legal to have one due to the constitution? theres some law that says you can defend yself with a gun I guess?

Btw its even illegal here to carry imitation guns, if youre using one as a prop for a movie you have to apply for a permit. We had some weird situations were ppl would do a movie and this guy just carried a AK47 in a trainstation, fake but he got nailed by a whole police team and got a HUGE fine.

I'm explaining to you their is a LEGAL question whether people want to accept it or not. No one has adressed the hypocrisy of the 2nd Admendment.

Anyways in America gun laws are generally done at the STATE level so in order to answer you question you would need 50 different answers.

Yes you need a CCW to carry. CCW stands for concealed carry weapon.

You can even have fully automatic guns (by another special license).

You probably couldn't get away with carrying it loaded in your hand. you'd get nailed for at the very least brandishing the fire arm and in most cases also some sort of charge for causes a domestic disturbance / threat of force ... etc. Just a bad idea.

But yes, most states, provide some ability for the citizens to get a permit to carry a loaded fire arm concealed from view.

the person on MTV that got arrested for having the "machine gun" ... it could have been that the person was under 21 (if it was semi auto short barrelled rifle or pistol), the gun was stolen, didn't have a concealed weapon permit, didn't have a class 3 license, or was in a state that doesn't allow the use of class 3 weapons (full auto falls into that)...

Personally, travelling to CA (or any place else) I feel a lot better knowing that people can't carry a loaded gun, permit or not.

I have a home in Ohio and a home in Arizona.

I own a fair share of guns. In Ohio, I get looked at like a criminal. In Arizona, I get looked at like a cowboy.

All depends on the state law.

But there are also permits you can get and some of those permits carry to other states. By having my permit in AZ to carry a consealed weapon, I can carry a gun in about 5 other states.

Depends on which State you live. My wife and I own several guns, we have permits to carry a loaded weapon (CCW) too. We livein Ohio, we can carry in a few States in Ohio. We also have a Floriday pemits from the State of Florida; with it, we are legal to carry a loaded weapon in most of our States (I think about 40).

Our country was only able to revolt against England becuase we had the firearms to fight back. Our forefathers wrote that into the constitution because they had the wisdom to realize that to remain the free country they envisoined, citizens might have to do that again some time... In WA you don't need to wait or go through any background checks unless you buy a handgun at a retail store.

If you buy any legal gun from a private party or a non-retail store you don't have to do anything but pay them your cash.

It doesn't matter if it's a hand gun, AR15 or whatever.

I'm not sure which part of that sentence confuses you. Is it "the"....or perhaps "shall not".


Now lets look at it in full....since most pro gun people only use the second half of the sentence.

A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

Most anti gun people say the "regulated militia" is now the military...and therefor obsolete. But i say....the military is run by a select few generals....& the commander and chief.

So who is to keep check on them to insure the rights of the PEOPLE? The people, & the only way they can stand up to a renegade army controlled by select people....is to have weapons themselves.

And just for the record, with the proper papers you can own a tank, as a historic artifact....as well as artillery (howitzers etc), troop carriers, and almost any other type of military equiptment.

You can live in your perfect little no gun world, but i'll keep sleeping next to my AK-47. So as soon as your little pussy anti-gun posse makes a law...and...decides to take it away from me....i guess you guys will come armed with sticks & tasers eh? Because certainly it would be hipocritical to seize it using the very same devices to secure the seizure?
