What recourse do I have?
I was having a very mini version of my site being sold as lease content with a content company. I haven't been paid for two months and he refuses to take it down now and obviously, refuses to pay me for it. I asked him several times to take it down, then I told him to and his response was pretty much, tough, I'll take it down when I feel like it..if you don't like it, sue me. He's in Canada, so he knows that's pretty hard to do. So I deleted the whole site from his server and he put it back up.
I am worried he'll never take it down and he'll continue to sell it, as he is doing now. I decided a few months ago to sell my whole site on my own, but with him having my stolen site already sold to people, it is really making it hard for me to possibly compete. Besides the fact that people might think I'm the one who doesn't have the rights to it! He's stealing from me, and hurting my business and just plain making me upset.. what can I do??? If anyone knows how to deal with this kind of situation.. I would appreciate any suggestions. Thanks Catalina |
shitty situation...
for 50k i'll kill him....and for 10k more i'll bring you his head |
So.. where can I steal it again?

Who is they guy? I think it's someone I never wanna do any sort of business with so would like to know.
|
I'm afraid to say who he is in case I can get in trouble by saying it publicly.. plus he's an advertiser on this board. Unfortunately, alot of people are already doing business with him ;(

Tell us...if this is true it will be resolved in minutes I think.

How much is the contract worth? Is there an arbitration clause? Is the other party in the US? If so, which state?

Well, he owes me for two months at $2500 each month and other stuff that I really just let slide. He's in Canada. I don't know what an arbitration clause is. We never had a written contract.. he has no license or model release.

Yes, that would be the site...

a;lsdkhfas;ldkghas;dlkhasdgah;sdkf serve him with dmca papers! and his host as well. yeah, thats the ticket.
|
Email his hosting company and explain it to them.... then demand them to serve you proof from him that he has a signed legal release in his possession... If he can't produce it, they are supposed to shut him down.
Some attornies will take your civil case on contingency as well. Being in Canada doesn't protect him. :winkwink: |

Thanks for the help! I really appreciate it. I have emailed his host.. we'll see if that goes anywhere. I also emailed some people who he is doing business with. I'll see what happens in the next few days and take it from there. I decided I'm not afraid of a lawsuit.. if my site doesn't come down in the next day or so.. then I'll go that route. I'm not going to let him push me around anymore!!
