Quick explanation of prior events. I assumed a property loan down the street from myself and took control of the property. I fairly quickly paid off the principle of the loan and it was basically near over, or I thought it was. I requested a payoff quote from the mortgage company. Approx total due was around 2300.00 left, yet needed actual payoff amount. This was in December of 2005. They say wait 15 days to receive a quote.

I hear nothing from them by Jan 06 so I speedpay in 1200.00 on one day and another 1200.00 the next day. (three western unions per day each for 400.00). I allow a few days to pass and call in again to get a payoff quote yet again. Verify mailing address, email address, fax number and then I also white list them in my email account just in case.

February rolls around and I receive my bank statement and it shows all six western union payments have been kicked back into my account, minus fee's of course. I did not find this out until after closing time at the mortgage company. Next day I also get a letter from mortgage company saying my account is in default, must bring it current blah blah.

I call them yet again and in a kind manor ask what the fuck? They say they can not accept partial payments and that the balance must be paid in full. I explain my prior requests for payoff quotes to get that balance and so forth. They assure me they will send one out. A week passes and I have received nothing.

I call yet again, they tell me since my account is in default that in order to issue out a quote they need to set up a payment plan. I try to make them understand that I just need the payoff balance and I will pay it that day, they refuse and say they must put together a payment plan and that I must sign a form and send it back to them with a copy of my ID. This will take no longer than 15 days they say. I ask when I get the payment plan and fill out the paperwork I can just pay off the entire balance right? They say yes or I can just make the payments as arranged.

I wait two weeks and nothing. I call in again and they tell me my payment plan was rejected (nobody told me) because the loan had matured. I ask what am I supposed to do then. They say I have to payoff the balance, here we go again. I demand a payoff quote and they say they can not issue it over the phone. They will send one off.

March is mid way and I call yet again. Have not received anything yet, what the hell is going on. Same damn run around that has been going on. We must mail it to you, we can not give it to you over the phone. Latter that night they call me or their collections department does. I explain situation and he gives me the payment plan ordeal and that is the only way, I am about to loose it by now. I do his fucking question list yet again, give out financial details and all that shit. I just need a fucking number though and I try to explain that to him and I would wire it the next business day. Nope!

End of March - call again no plan, no quote. Apparently they rejected my plan, hmm didn't see this coming. I am on them like white on rice now.

Ok today hooray in my email I find an email from them. Its the fucking payoff quote. I am so damn happy as I download the pdf file, that is until I open it. Inside is my balance, the interest for the last several months (no problem there), and two amounts for attorney fee's and title reports. Basically an additional 1,100.00 in extra "fines".

I call them up and ask what the fuck? They say that since my account has been in default since February they have incurred legal expenses and such. I explain the whole issue and problem. How my account would not of been in default if they did what they were supposed to have done and let me pay them etc. Fucking bitch just keeps going on about and what is your problem. How about that your damn company would not let me make payments, would not tell me how much I needed to pay, I sent back my money when I tried. She literally blamed all this shit on me and could not see the problem.

Do I pay this damn thing off without a fight now? They basically fucked me hard and just racked up a 30% extra balance and smeared my credit score.

Why didn't you just go to the company in person and write a check? Seems like that would have saved you lots of time, money, and hassles.

I'd be burnin' up the phone demanding they contact equifax, transunion and experian and clearing up the credit report immediately.

Go to the top of their food chain, whatever exec that is - skip the talking head rep and deal with someone of importance.

All financial institutions suck these days. They've completely lost touch with the fact that we're the customer. They expect us to regard their service as some sort of privilege.

Thats fuckin bullshit dude. Go there in person and don't leave until your satisfied, I hate pricks like that, a personal visit always seems to get things resolved better.

I am not sure what I am going to do right now. I will not tempt fate and fly across the country to meet with them though, that is for certain. As I am almost positive that if they did not give me the answer I want within a few seconds I very well would end up in jail.

Just on principle alone, I would contact an attorney in Florida ASAP. I know that it would cost money, but I would pay it just to see that they DON"T get recouped for their "costs". Make sure that you have a record of what was talked about on what dates, and who you spoke with.... the more details the better. I would do this ASAP.

Just my two cents, but I tend to get really irate when people or companies pull this kind of crap on me, and I will expend more money and time just to make a stand on it.

Any sensible judge would dump the lot back in their hands and award you damages and costs - but, we ain't necessarily dealing with "sensible judges" either. The lot is fucked - it's no wonder iBill management are still walking.

hmmm... I realise it's an additional expense but I'd sick an attorney on them just on principle, as well as bcc them on complaints to all the right people. :thumbsup

Been going over my original loan documents. See the loan was sold to OCWEN after I purchased the property. So the original loan rules apply to them either way, and one slight glimmer of hope. It has a California jurisdiction clause in them, so we get to fight here.

I've had a lot of different scenarios play out in the last couple of weeks, and someone hit the nail on the head earlier by suggesting that you go to the top of the food chain.

Your first job should be to contact them and make sure you're escalated to the VP or Prez or CFO someone with absolute authority. Then you should explain the situation to them entirely -- all of this should be accomplished in a peaceful manner. If you are able to do this I can almost certainly guarantee you that your case will be closed, the additional fees dropped or reduced and your credit cleared.

Any other approach is drawn out and will not get you the ultimate results you're looking for.

Let us know how it gets resolved :) I'm quite curious.
