Acquiring a .com domain when you own the net/org
 
How would I go about acquiring a .com when I own the .net/org? Do I have to form a company with the name or what? The domain is owned by

http://nameadmininc.com/

If you know anything about them they just run ppc pages on all domains they buy and they definitely do not sell domains they own.

make them an offer they can't refuse. you have no rights to the domain name unless you own a trademark. then there is the whole thing about what was registered first...the trademark or the .com.... so you probaly have no other choice but to buy it..

I have sent various offers, they don't care. Here is some info in their FAQ

Nothing you can do about it... even if you register a TM, their domain was there before your TM.

But if they just run PPC on it, im sure they won't refuse 20 or 30 years of PPC income (that is if you really want the domain)

Who says anything about email? Find out their office, phone number etc and get in touch directly, and make sure not to lowball on the first try

theres a few diff laws that apply here , i dont think its that cut and dry.. if he owned the .net first and used the name "thus trademarking it" and they are selling any competing products on that ppc engine they might be liable

i owned a domain once that was like www.simpsonsonline.com the simpsons already had their own webpage but wanted to open a service for "simpsons" fans , the page i made was just made as a "fan" page and just had simpsons photo's on it, when they came online they bought the simpsonsonline.net , but they registered it AFTER i had already been using the .com version and logo's saying "simpsonsonline" , even though the name itself "simpsons" was trademarked , because i wasnt selling a competing product and because they registered the domain AFTER me they had to settle and make me an offer instead of taking me to court ( or they just decided the offer was less than the legal bill would have been ... )

p.s. this is just an example . it did happen but wasnt the simpsons..

I could easily brand the .net to work the way I want it to but I figure a shit load of traffic will end up going back to the .com because most surfers think of .com first.

There is no way to go about acquiring it. They own it and that is all. Unless you already own a trademark on the domain, it will be theres forever, until the end of time. Even when all the stars in the universe fade to black, and eventually even the subatomic particles which make up all matter in the unverise decay into nothing, they will still own that domain. If you really must have the domain though, then I suggest you offer them a ridiculous amount of money. Start at 6 figures and see if you get a reply.

How much have you offered them? Name Admin Inc. is the type of company that will not even bother doing business if the transaction is less than 6 figures. Unless the domain is super crappy, then they might be willing to sell it to you for a high 5 figures.

no, I didn't own it before.

I'm not going to offer some outragious amount for the domain. I doubt it's even getting any type-ins. I'm really not sure why they wanted it to tell you truth, probably because they are hoping some day someone will come along and offer an outragious amount, just won't be me :winkwink:

when i registered fris.net in 1998. .com was taken and was parked, its still parked now. i emailed they wanted 12k for it. for bascially a parked domain, they didnt provide any stats, the park service its ok is not a ppc domain park system either

That guy does not sell domain names, he owns over 400k names I believe, and he does not need any type of money you offer, because he makes a killing from his domains. You are wasting your time.

I had the same situation happen to me and asked about it on GFY...basically somebody snatched up my real name...unlike your situation they wanted 13k (yes...for my own fucking name). i told them to fucking shove it and regged my name last initial.

if i was you i would just do the .net thing. get yourself some nice decent traffic then reapproach the guy.
