What are the laws on taking them? I see guys out on the beach all the time with cameras and I know they are not going to put them in their scrapbook. Pam and tommy lost some court battle? Can you do that?

Well I do go to the beach just about every day for walks and maybe some yoga. I happen to see the girls laying out topless or bottomless even and every once in a while there will be some dude with binocs and a camera with zoom lens. I just mind my own business but was curious as to the laws for this. I remember that tommy pam anderson video the judge said that because they did there thing in public they gave up the right to privac... Was this correct?

sunbathing topless = attracting attention = newsworthy = legal to make pics / report news...

Couple of potential probs I see here...

a) You have no idea if the "model" is 18+

b) There is no signed release allowing you to use the images for commercial purposes.

It may be (borderline) legal to take images of people on the beach - clothed or otherwise - for personal use, but for commercial use you'll probably run into issues.

BTW are people in your area going "no cameras allowed" crazy too? Around here if you're at a beach with a camera and there are children around you're considered a perv. I was taking pics of rocks, well away from people, and I still got some dirty looks from parents! The one time I was at a busy beach taking pics of my daughter I made sure to use a wide open aperture so that people in the bg were blurred... and I still felt uncomfortable.

Cameras have been banned at many swimming pools, I'm not even allowed to take pics of my daughter even if no one else is in the pool...

Rowan, I have heard nothing of this no camera policy but it does make some good idea. Underage models refs to sexual acts. But a girl laying at the beach topless who is say 17.. is that considered explicit sexually? Maybe one day I will ask one of those dudes at the beach what is up and the url of his site. He probably won't tell me. Maybe I should just call the cops but I don't think they will care. Maybe I should call the President?? ha ha.

Yeah, topless pics of a minor would probably not be considered sexually explicit, but you'd still be walking a fine line IMHO. Don't forget you cannot legally use them for commercial gain, as well. Not that it stops many sites.

Just on a side note, I want to say that those candid shot sites really creep me out, to know that some guy with a telephoto lens is snapping away at the girls on the beach. shudder

Only newsworthy if you present it is a newsworthy fashion - taking pictures of someone topless on a beach and then presenting them in a porn context rather than a reporting context would almost certainly blow past the line.

It is a very, very questionable concept.

"Commercial" photography on ANY Federal and most State owned property, beaches is illegal without a permit. If the photo generates a profit in any way shape or form .... permits are needed.

You probably won't get caught ... but ... the local cops are also probably sick of seeing a continuous stream of assholes shooting unsuspecting women on their daily beat.

Imagine the pain-in-the-ass factor of Federal/State Cops arresting you. The FEDERAL court you might end up in. The bizarre laws that might be on the books.

Fish, Wildlife, Game Officers have search-seizure-arrest powers that are the envy of any local cops.

You also might get the shit beat out of you by a pissed father or boyfriend.

just go to the beach with a stack of 2257 docs and let em sign those first before you secretly photograph them
