if you were covered , they have no right to make you undress in any way just to see what you "were" wearing.. , but did they MAKE you or "ask" you.. they can ask practically anything .. you dont have to comply.. problem is they would have arrested you at that point , but thats the way it works , you have to deny them permission , then let them arrest you , and it will be thrown out , then the next time do the same thing and you can charge them for hassment. it sucks that you have to make them arrest you in order to prove the legality of what your doing , but thats the crux of it

Again anytime you are ticketed you are technically under arrest! The only reason they didn't take me to the station was they were told by there superior that it would of give me too much publicity (the cop actually told me that). Melissa, the police had no grounds for making you remove your undergarments nor examining your pasties unless you were openly baring your breasts. Regardless of you baring your breasts, your undergarments had no reason to be removed, especially without a female officer present. With the incident on tape I strongly suggest you contact the Nebraska chapter of the American Civil Liberties Union (http://www.aclunebraska.org/). How clear is the video? Make multiple copies of it, and take one to the Lincoln Police headquarters and file police misconduct complaints against each of the officers assulting your crew during the incident. I reccomend doing this with your attorney present.

No, you arn't technically under arrest until you've detained and/or read your Miranda Rights. An officer must formally inform you that he placing you under arrest. When recieving a ticket or citation of any kind, ask them "officer, am I free to go". Unless they have cause to detain you, you are under no legal obligation to be held by them. If they violate this right you should file a formal misconduct report.
