How many forms of ID do you need per model?? I have a model who has a state ID card card that clearly shows his age, is that enough? Or would I need a second ID?

as long as it has a photo that's acceptable

If my attorney told me something, I wouldn't be asking here would I?? FYI - I don't have an attorney, as I am not on that "Level" of needing one just yet.

If you are involved with content production on any level and have not spoken with an attorney then you are doing something wrong.

If you are dealing with talent then you are on that level of needing one.

That said, one ID that is state or Government issued that is valid and not expired is what is required. Though more than one ID is better.

First of all I've only shot one model, so why waste money to consult a lawyer when I can ask people here who already have. The question is why would you come to an industry message board asking about a law which pertains to the well being of your business as a whole instead of consulting a qualified professional. The min. is generally a picture I.D. with a D.O.B.. Such as a D.L., or passport, etc. However, most people/companies will ask for more than one just to cover themselves.

I normally tell them a D.L. and S.S.C. (mainly so I have their SSN for their 1099 at year's end if they are over $600), however a lot of them do not seem to carry or have a SSC on them, so I will take a secondary I.D. like a college I.D., birth cert., or something of that matter. Something hard enough for someone to fake, or that can prove who they say they are.

Now, back to what they are saying. The reason you should consult a lawyer is because of more than the I.D. issue. You also need them signing a model release, and THAT should be done/approved by a lawyer to cover your ass when working with 'talent'.

Instead of assuming things, people should ask what I am using the images for. #1 is not for a content production business, or any type of business for that matter........ I simply wanted to know the answer to that question since it was bought up during an IM conversation with an associate.

I use one of the top 2257 attorneys and he tells me I only need one goverment issued ID. But I always ask for 2 to be safe :2 cents:

unmgroup...people have already answered your question but i'd like to add the more I.D's the better. It covers your ass. If you can get 1,000 pieces of I.D. from one person then get 1,000.

A minimum of two would probaly be the best way to go about it though.

He mentioned that he had not consulted with a qualified attorney - which mean he's missing somthing else just as important as the ID's - a legally binding model release. I'm just trying to keep people out of the frying pan, but screw me, right?

Minimum of 1 government issued ID is all that is needed. As suggested best to go with more then one, but they must be government issued. School ID's and such are no longer valid.

Don't forget the model release, photographer release, location release/contract, AIM tests, and all IRS forms filled out... but I'm sure you had all this handled before the first photo was taken, as any professional would.

Also as stated, If you're just starting out, great, I wish you the best of luck. BUT, now is the time to consult a lawyer and develop or purchase a 2257 management system to help keep you organized. Make sure you contracts are worded correctly and protect you. Another good thing to consult a lawyer about is the pesky little state and local laws.

Here's the problem with asking for advice on a forum like this one.....

Not one single person has given this guy a 100% letter of the law answer. The answers that he has been given don't even really matter because the guy still doesn't know what is required for filing the paperwork. Doesn't matter if he has shot one model or 30,000 models.

According to the current regs, if he followed the advice given here, with the exception of consulting with an attorney, he would still not be compliant under 2257. In fact, based on the advice that most of you have given him, he may very well be in direct violation of it depending on how he filed his paperwork.

So unmgroup...To answer your other question about why should you pay an attorney a this point instead of asking others here who have already done that.... Most of them are wrong and to be honest with you, most of them are just like you...Too fucking cheap to consult with a proper attorney so they have listened to others. How do I know this? Because I do pay First Amendment attorneys for this info. I am also one of the few non-attorneys who is invited to speak on industry 2257 panels.

AaronM does know this area of law quite well, and he has certainly engaged me in lively discussion where he was right and I was wrong--find another lawyer that will admit THAT.

This is a fairly simple question that has a simple answer--but there are a lot of related issues that you would need to understand to be 2257 compliant, not just the number of ID's you need to see. I wouldn't mind taking the time to type out the full response, but I am going to wait for someone with a bit more humility and a lot less venom to ask it. It does pay to be nice. The adult community is very interconnected, and anyone who has been in the business for any length of time understands how important good relationships with other business owners really are. If you remember the old movie Stripes when the drill segeant told the obnoxious egotistical recruit "One of these men might save your life one day!" to which Bill Murray quipped, "And then again, one of us might not"

its all good, I only answered from the side of what we need to be able to publish a set and be compliant. I'm not as photographer, so I'm sure there is more that needs to be done on your end for yourself/clients/models
