US Title 18 2257 - How many forms of ID do you need?
How many forms of ID do you need per model?? I have a model who has a state ID card card that clearly shows his age, is that enough? Or would I need a second ID?
|
as long as it has a photo that's acceptable

What did your attorney tell you? |
If my attorney told me something, I wouldn't be asking here would I?? FYI - I don't have an attorney, as I am not on that "Level" of needing one just yet.

If you are involved with content production on any level and have not spoken with an attorney then you are doing something wrong. Not at that level yet? WTF does that mean? That's level 1. |
Quote:
That said, one ID that is state or Government issued that is valid and not expired is what is required. Though more than one ID is better. |
Quote:
First of all I've only shot one model, so why waste money to consult a lawyer when I can ask people here who already have. I don't have some big content production business going on, so spare me the wise ass comments. It was a simple question point blank, so get the fuck off of my back, and get on your wife's! |

Fuck you, and fuck your motherfucking opinion. Point blank, I know when it's time to consult a lawyer. Thanks Matlock, it was a simple question and you want to twist things into some heated discussion. I didn't ask when it was time to consult a lawyer, I asked how many forms of ID. That's all. Simple isn't it?? So spare me the sarcasm. Because if I wanted some, I'd watch an episode of golden girls. |

The min. is generally a picture I.D. with a D.O.B.. Such as a D.L., or passport, etc. However, most people/companies will ask for more than one just to cover themselves. I normally tell them a D.L. and S.S.C. (mainly so I have their SSN for their 1099 at year's end if they are over $600), however a lot of them do not seem to carry or have a SSC on them, so I will take a secondary I.D. like a college I.D., birth cert., or something of that matter. Something hard enough for someone to fake, or that can prove who they say they are. Now, back to what they are saying. The reason you should consult a lawyer is because of more than the I.D. issue. You also need them signing a model release, and THAT should be done/approved by a lawyer to cover your ass when working with 'talent'. :disgust |

First of all, I don't have a business yet, so get your facts straight before you start running your cock sucker. Second of all, this is an industry form correct, so why not ask here? This would be the perfect place to get a quick, and correct response. As for research, I googled as well as posted here, so don't comment on what the fuck I haven't done, unless you're standing over my shoulder watching me. Once again, I didn't ask for your ADVICE, Suggestions, or comments, I asked for the answer to a very specific question. And speaking of law school, brush up on your "getting to the god damn point" skills, because this isn't a direction examination. This is a cross. |
Quote:
Thank you very much. ;) That was the response I was looking for. Instead of assuming things, people should ask what I am using the images for. #1 is not for a content production business, or any type of business for that matter........ I simply wanted to know the answer to that question since it was bought up during an IM conversation with an associate. |
No problem. Happy to help.
Just like any normal job out there that asks you for a picture I.D. and 2nd form of I.D. when you are hired, you should do the same. Again, just to cover yourself. :rasta |

2. Yes it's an industry forum, you asked the question, and you were promptly instructed that the correct answer was to consult an attorney. Specific question, specific answer. 3. Peppering your 'business' posts with obscene comments to try and convey your message makes you look like an idiot. No one wants to do business with an individual who embarrases himself by coming off on industry boards as someone with a temper who can't take advice from qualified photographers (AaronM). Also, it doesn't matter if this is for content production or not - you're still the primary producer. |
I use one of the top 2257 attorneys and he tells me I only need one goverment issued ID. But I always ask for 2 to be safe :2 cents:

Sweetheart, just because you shoot content doesn't mean you are doing business. I think you'd better choose your words wisely. Doing business is when I'm selling it, marketing, or promoting it. #2 It was suggested that I speak with an attorney, that does not answer the question at hand! I mean seriously.....what law school are you attending?? Joe Blow's 8 hour law degree course??? Because if you thought that answered the question, you've seriously got a long way to go buddy. #3 Opinions are just like assholes, everybody's got one. Infact, I'll share mine of you.... I think you are a lonely douchebag who needs to get a fucking life. With that said, have I ever asked anyone on this bored to do business with me? (LOL) Who even said I was doing business. See, there you go assuming things, and we all know how that old saying goes... When you assume things..You make an ass out of yourself. Point blank you are an idiot..... this question was too simple: "How many forms of ID do you need?" ... If you couldn't answer the question, then don't post. I didn't ask for opinions on when I should consult an attorney for the millionth time. I didn't ask was the sky blue today? The question was direct, and to the point. |
Quote:
Thanks! :) See people, it doesn't get any simpler than that! Direct question, direct answer. |
dissipate STFU...it's not your thread. answer his question or get the fuck out. he didn't ask for consulting services.
unmgroup...people have already answered your question but i'd like to add the more I.D's the better. It covers your ass. If you can get 1,000 pieces of I.D. from one person then get 1,000. A minimum of two would probaly be the best way to go about it though. |

unmgroup, you are a fucking tool. You're new to this biz and already jumping up everyones ass :1orglaugh get fucked d00d.
I'm sure you're unaware that GFY isn't always the place to get a straight forward answer. Learn the ropes before you start spouting off like billy badass |
Minimum of 1 government issued ID is all that is needed. As suggested best to go with more then one, but they must be government issued. School ID's and such are no longer valid.
Don't forget the model release, photographer release, location release/contract, AIM tests, and all IRS forms filled out... but I'm sure you had all this handled before the first photo was taken, as any professional would. Also as stated, If you're just starting out, great, I wish you the best of luck. BUT, now is the time to consult a lawyer and develop or purchase a 2257 management system to help keep you organized. Make sure you contracts are worded correctly and protect you. Another good thing to consult a lawyer about is the pesky little state and local laws. You can take my words or leave them, makes no difference to me. |

Suck my ass you human cum dumpster. You're damn right I'm new, and that means what? If I want to know something, I'm going to ask it. Now you may not agree with the question, or how I asked it, or even my response to advice.....and frankly I don't give a shit. I don't come on this board to be liked, so understand that, since it's obvious you can't understand a simple question. I have a life out side of this board, I mean really...Who said I gave a fuck about being liked? lol, you can't possibly be serious. I am me 24/7, 365 days of the year. But all of this strays away from the question, so why is it even being discussed. It's obvious the majority of you lack reading comprehension skills. How the fuck do you take a simple question, and make it into a discussion?? lol, Who, What, when, where, and why was never asked. "How" was! |

Allthough I don't think you'll give 2 shits but if you're asking questions, you're going to get nothing but asshole remarks if everyone thinks you're a prick. |
Here's the problem with asking for advice on a forum like this one.....
Not one single person has given this guy a 100% letter of the law answer. The answers that he has been given don't even really matter because the guy still doesn't know what is required for filing the paperwork. Doesn't matter if he has shot one model or 30,000 models. According to the current regs, if he followed the advice given here, with the exception of consulting with an attorney, he would still not be compliant under 2257. In fact, based on the advice that most of you have given him, he may very well be in direct violation of it depending on how he filed his paperwork. So unmgroup...To answer your other question about why should you pay an attorney a this point instead of asking others here who have already done that.... Most of them are wrong and to be honest with you, most of them are just like you...Too fucking cheap to consult with a proper attorney so they have listened to others. How do I know this? Because I do pay First Amendment attorneys for this info. I am also one of the few non-attorneys who is invited to speak on industry 2257 panels. I'm sure at this point that you will have a clever retort with lots of colorful words....Save it for the school yard, son. Take your shit ass know it all attitude and GoFuckYourself. :321GFY |
Quote:
Not very smart considering that part of what he said was dead wrong. :1orglaugh Sorry, Dan....But your answer was not quite right. Damn close though. :winkwink: |
AaronM does know this area of law quite well, and he has certainly engaged me in lively discussion where he was right and I was wrong--find another lawyer that will admit THAT.
This is a fairly simple question that has a simple answer--but there are a lot of related issues that you would need to understand to be 2257 compliant, not just the number of ID's you need to see. I wouldn't mind taking the time to type out the full response, but I am going to wait for someone with a bit more humility and a lot less venom to ask it. It does pay to be nice. The adult community is very interconnected, and anyone who has been in the business for any length of time understands how important good relationships with other business owners really are. If you remember the old movie Stripes when the drill segeant told the obnoxious egotistical recruit "One of these men might save your life one day!" to which Bill Murray quipped, "And then again, one of us might not" If you want to be in the adult business, you WILL need the help of others. Some might help you. Some will not. |
Quote:
Also, I believe as a company we pay thousands of dollars monthly in legal fees to keep ourselves compliant. Cant give away all the advice we paid for, for free can I :1orglaugh |
Quote:
Thanks for the kind words, Chad. See you on a couple of days. :glugglug |
