2 sue some1 in canada - ??!
 
Hi all!

just decieded to take a fucker in court to get his site closed and wanted to hear if any1 have dealt with canadian fuckers and what the fastest way is to get it 2 court....

In short I had a webmaster who tryed to ruin on of my sites with false claims last year on his sites (still there).... I told him there would be a payback....

now I want to claim that payback so anyhelp would be appriciated!

I want to get his site down.... his address is in:
Montreal
Quebec
Canada

Anyone from there who got any tips on getting this to court fast and what to expect?

first off im in europe!

I have an layer but SHE says it will take time for her to investigate (read between the lines $$$$$$$ ) as she is not into canadian law.... so I need someone with a little usefull info and maybe if someone knows a good online or canadian laywer i can contact I would be very happy!

Also I could just ruin their server BUT i want real payback meaning him loosing his paycheck!

You can just get an order to remove any libel from a USA court enforced in Quebec Provincial court...this is pretty easy.

I doubt they would take his sites down, or that you can obtain damages.

With situations like this it is where I wished I got into law. There must be a lot of money in these kinds of cases that involves international law.

If this guy really did screw you over then good luck to you, but honestly, its very likely that you will spend $10,000 on lawyers and you may or may not win your case.

Why don't you explain the situation to us a little more? How did this guy screw you?

vidsweb <- he screw me by posting false information about me + another respected gambling webmaster.

I've run gambling sites since 1998 and it was at a time where competetors and gamblingsites where popping up all the time.

I lost a few affiliates but got em back by emailing every single webmaster who ever contacted me and I explained the situation... but I lost an adcampaign on my site for a rather big online casino!

its a tough game at times and I agree that you do what you can to win or put competition out of biz.... but his plan bagfired and now revenge is near!

if u do pay a lawyer make sure u get one based in Quebec, its my understanding that Quebec, differs slightly form the rest of Canada.

My advice stick to the bikers :)

Pipecrew is right They use the Napoleonic code in the Quebec Justice system.And it is as antiquated as the name implies. So good luck , the other altenative is the private solution:BangBang:

hmmm interesting but can it really be that hard to get a site down and or changed.... hell im gunna send him so many hits that site will never be up again.... sounds much easier....

Well, good luck to you, cause suing people aint cheap!

First of all you would have to prove that it actually was him that posted those messages about you.

That means you will probably have to get the IP number associated with that post, then you will have to trace that IP number to an ISP, then you will have to get the ISP to release the server logs for which one of their customers had that IP number at the time that post was made. Keep in mind that ISPs probably won't give you that information unless you have a court order for them to do so.

So just proving it was him that made that post will be a difficult task in itself, let alone determining whether he is guilty of spreading false information.

that easy very easy -> i've talked with his host but i think he is his own host so that did not help....

so if it gets to court in very sure I will have no problem proving it was him...... it happened some time ago but like an elephant i never forget and saved all info on the case!
