So i won my court case today . . . . . . . .
 
judges are fucked in the head.

contractor sued me for $2000 owing on some work he did - fucker did like $4000 in damage to my home and OVER billed me $2000 so i counter sued for $4000.

Won the sue - his $2000 was dropped - and I won the counter suit - but for $750 only. The judge dropped my legal fees (apparently that's the law - $1000, ok) - and one aspect he said I was going to do anyway for another $1000 - but of the $2000 remaining he only billed the bad contractor for MATERIAL - not labour to fix it - WHAT THE FUCK???? the labour was OVER $1000

when i questioned the judge about it he said he MISSED the labour part and i can appeal but his jedgement was already made. He admitted the fucking MISTAKE!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


it costs me MORE than $1000 to take a day off work and goto court and appeal. FUCKING ASSHOLE

I'm really tempted to write a letter to the local newspaper saying 'open season on contractor client' just to piss off that judge and attach his name to it. it's not worth my time to appeal but it may be worth it to appease me on how pissed off I feel to write a letter to the paper.


fuck that was a messed up judgement - although the bad contractor was in total shock he lost and couldn't beleive I asked the judge for MORE money and the judge AGREED he made a mistake but the judgement was already made. I left the bad contractor thinking I was going to appeal for more money just to make the assholes day. :thumbsup

The guy sued you and you walked out of court with an extra $750 in your pocket.

All in all not a bad day.

I've read some real horror stories about people getting screwed by contractors on new homes and when they go to sue the contractor is gone....poof....corporation dissipated and the same guys are operating under a new name and you can't sue them.

At least you were able to get this guy into the courtroom.

Yeah I noticed that, I read your whole post.

It's just that your situation reminded me of the stuff I read recently about shylock contractors and I was thinking that at least you got a little justice after the guy did fucked up work. (When you think about it you're up $2750...the 750 you got plus the 2k you didn't pay)

Just write the guy a letter and ask him if he wants to go back to court on the appeal or take care of it now.

Am sure it cost him money to show up as well. If he heard the judge admit he made an error he may decide it isn't worth taking another day off work.

Use spellcheck on your letter to him

Nice... nothing worse than someone fucking up your house when they are supposed to fix it. Sucky judge though... what a prick... I'd go to the BBB and other organizations like it and document the judgement there so he gets less business... Also see if he is a member of the chamber of commerce and talk shit about him there.

Good advice but I would get your lawyer to write it. $100 for his letterhead will make a difference.

Or you could tell him the local papers need to know about this case. :winkwink:

been thinking about this - once they mail the docs to me I am going to send a letter to the paper. It's total and UTTER BULLSHIT the judge didn't grant me labour costs and sends a message that it's open season to rip people off. It was well over $1000 in labour costs and the new guy charged LESS than the bad one.

Well if you think about it, the Judge didn't make it "open season to rip people off". I mean, he admitted he made a mistake, right? If the law doesn't allow him to alter his judgment, even when he's knowingly made a mistake, do you really need to harass the guy? Other than not making a mistake, what could this judge have done? Don't you ever make mistakes?

Anybody looking for justice from the court system is NEVER satisfied. Either the laws aren't in your favour, the judge is having a bad day, or you have to spend way more of you cash just to show up than you would ever receive. It's a freakin' farce!

All court proceedings are taped. You can get a transcript (usually free) of your proceeding and then file an appeal. When the appeal goes for review and they read the transcript on the Judges mistake they will overturn the ruling amount.

Would I do all this for a $1000? Fuck no! Take your money and run.

You should dude - Thats good viable information that the people should know about. I'm positive that the paper would be intrested in talking to you about the case and then spin it as a watch your back with these contractors type of story.

CDN small claims judges hate legal fee claims because they hate lawyers.

I have been to small claims a few times. I pay a lawyer to help me prepare my case (usually a few hundred bucks) and I go in on my own.

Judges then see you as the little guy fighting for his rights. :0
