We are a movie reviewer (and Television), we review for the nudity content rather than the dramatic content. As you can see our reviews are more enticing than Roger Ebert's to the male viewer. We use pics and clips to emphasize the reviews.

Our site pushes millions of dollars of DVD sales and theater ticket sales as well as Mr. Skin's appearances on over 500 radio shows per year, including Howard Stern. So the Movie companies love us b/c we promote the sales of their movies. We also have a book out called: "Mr. Skin's Skincyclopedia: The A-Z Guide to Finding your Favorite Actresses Nakes." It has done very well for a reference book.

So in answer to your question, it is called Fair Use, if Roger Ebert can review a movie, so can we, even if our reviews differ from his (Thank god).

Doesnt Fair Use mean you also have to include the original source?

Section 107 contains a list of the various purposes for which the reproduction of a particular work may be considered fair; such as criticism, comment, news reporting, teaching, scholarship, and research. Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair:

1. the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;
2. the nature of the copyrighted work;
3. amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
4. the effect of the use upon the potential market for or value of the copyrighted work.

Its commercial, copyrighted and a substantial part of the site, that would be good enough for me to sue.

Oh they have I know, so because the movie companies dont care its ok to call this fair use, that puts a whole new perspective on making vids available to the public.

Well if they think its ok, they think its ok. Id rather sleep at night.

I visited the Mr. Skin Crew at their offices in Chicago in December. I saw their screening room, library, (and very cool mini recording studio:thumbsup) and its full of videos & DVDs, so if the movie studios are angry about what Mr. Skin is doing they certainly haven't stopped sending him movies to review:pimp .

We've had a simular site in Holland/Belgium, it was kicked by both the host and processor. So I was wondering how Derek did this legally.

Just gathering information. Im sure Derek is a cool guy.

I have no clue etc how everything works. BUT

We when I have exclusive content. I keep it for myself, own site. However, when an affiliate can push 43489048284 sales with my content to my site, I think it's ok for him to use my content...Guess the same works for these movie companies...They don't care as long as sales are coming in...Legally they migt be still not okay...But as long as noone press charges....

Just to clarify, with any legal matter I consult with our attorneys. Our business has been around since 1999 and movie companies have been sending us movies to review since 2000. Luckily for me we are the most trusted name in Celebrity, so I would just say if you are that uncomfortable promoting a site that does business with every big player in the adult industry and the mainstream hollywood studios, then don't. I am not in the habit of making people lose sleep and I don't want to start now.

As I see it and they also said its "review" and same guidelines as Ebert & Roeper.

Then those four factors are only to be used to help determine. Still though if you apply same concept as Ebert & Roeper to them you get same results.

They rebroadcast clips of movies to millions of households.
Their show is for comercial reasons. They do sell advertising and cable companies or chanels do pay to have the show.
They are rebroadcasting copyrighted material and their show itself is copyrighted.
Their reviews/clips are a substantial part of the show.
They have the effect of causing viewers to purchase tickets, dvd's, and so on.
