Can you sue someone for lying in court?
 
A friend of mine is going through a divorce. One day out of nowhere the police show up along with the guy she is divorcing with a court order to take their kids from her. Her husband apparently went to the courts and filed some type of emergency restraining order claiming she is a cocaine addict and that the kids were not safe with her. The judge granted the order based solely on his word and no proof whatsoever. It was a complete lie, she went and had a hair follicle test done the next day and passed it.

In the meantime though until they went in for a hearing she was not able to see her kids at all. Four months went by until they went to court. She did get her kids back but they ordered her to pay him child support for those four months and they did nothing to him at all for going into court and making this shit up.

This guy is a real fucking prick. They were together for 15 years and during that time he would constantly try to kill her self esteem by telling her shit like no man would ever want her because she's ugly (she's not at all), always told her she was worthless, etc. and in the meantime he cheated every chance he could. So when she finally decided to leave his sorry ass he found out about it and threw her and their kids on the street with just the clothes on their backs and kept everything (including her clothes, car, money, etc) until the courts forced him to divide the property which took at least 8 months. By then of course he had gotten rid of everything. He has really manipulated the system and lied constantly in court and for some reason the judge in their divorce let him get away with it.

So I told her she needs to sue his ass for the damages of going into court and lying. Anyone have any experience with anything like this?

Call a lawyer #1 most importantly. This is the wrong forum to ask for legal advice. Half of the posters here can not be held liable for anything they do because they are under the age of 18. GFY should have a forum for parents of GFYers... if they did, that would be the place to ask.

I think it depends if he did it inder oath or not, also it is pretty hard to prove that she wasn't addicted to cocain at some point and he didn't know she dropped it...

Yes it was under oath. He even gave specific dates of coke use and the hair test disproved it. All the dates he gave were within a week of him claiming this and hair tests go back 3 months.

Stay out of it they were together for 15 years. there is 2 sides to every story and I'm sick of all the girls who do the whoa is me bullshit. if it was that bad she should have left earlier everyone has choices in life. don't try to help somone who cant make there own simple choices it will bite you in the ass later, trust me.

And apparently you did not read that entire thread, because stuff like this was discussed...Divorce is almost always ugly, lots of bullshit stories, and accusations are usually tossed around.

However this does not negate the discussion that was being had, that if you are court ordered to pay child support you are lucky if that's all you have to pay. Raising a kid is expensive, and most men I know who have to pay child support are getting out on the cheap side, including my brother in law.

We had someone tested for Cocaine after he abused a girlfriend of ours, he denied it, so I took him to court, it turned out he was on cocaine so they made him pay for the test, if we had lied the court would have made us pay for the test it was like $1200 for the test and court fees.

But this case is much different

And suckonthis, don't know your situation exactly or how things are handled in your city but this is the kind of stuff judges see day in and day out in divorce cases.

People are always making up the wildest stories in order to gain leverage whether it be for monetary distribution or custody.

Justice is slow in family court as well, and requires a person to have a lot of patience during one of their most difficult times in their lives.

A similar thing happened to my father, after having custody of my brother for 9-10 years my mother makes one false accusation to the court and my brother was whisked away for a year.

The problem with the family court system in Fort Worth is they have what they call a "masters court." It's supposed to streamline the process, it's a lawyer who is chosen by the Judge to handle all preliminary motions, so it can take 1-2 years before you even get in front of the real judge.

You can by law request to skip the masters court, but that usually pissess off the judge so lawyers always advise against it.

After dealing with the bullshit for a year, my father was handling his own case and I was doing all of the filing I finally talked him into just skipping the Masters and having it kicked up to the judge.

He did and within one day my father got custody back and everything was over.

Family court is a crazy experience and I don't wish anyone should ever have to go through it.

People very rarely get charged with perjury unless it is a big criminal case, even then doesnt happen often.
