Perfect 10: Time for a legal action

(Following http://www.gofuckyourself.com/showthread.php?t=561808)

As it could be completely demostrated, Perfect 10 has get that Google removed hundreds of websites just because they are using some promotional (and totally legal) images from sponsors as Hegre-Art, Modelflats or Bumblecash.

Perfect 10 bought some of those images, yes, but it hasn't the exclusive rights, so before to start a global request it should look carefully every case.

Some of our partners have started a process for Google brings us again to its results, but, knowing that Perfect 10 note is from 22 December and Google's response was about 8 January, I'm almost sure that we will continue banned at least one week or two weeks more...

Meanwhile, we are loosing traffic, money and, most important, credibility. Perfect 10 has defamed us calling us thiefs with no previous advice, no proofs, no reasons!

Me and a some other honest webmasters we want a compensantion for the serious damages, including our reputation, in this way:

$1000 x day banned at Google x website

If this goes to the court, we have the security that we will win, just because when Perfect 10 sent the note to Google, they accepted the following part:

"I have a good faith belief that the use of the Perfect 10 copyrighted material in the manner complained of in this email is not authorized by the copyright holder Perfect 10, its agent, or the law. The information in this notification is accurate. I swear under penalty of perjury that I am authorized to act on behalf of Perfect 10, Inc. the owner of the exclusive rights in the material which is being infringed."

As some other webmasters told, this is not the first time and I'm sure that if there isn't a hard response, this will not the last one.

So we need a legal firm to get all this to the court. If we see the number of webmasters at the list, we will know that we could tall of a millionarie sum of money that I sincerely wish represent the end of Perfect 10.

Some of us are from Europe... Anybody has or know a good legal firm in USA?

This is time for a legal action!

file a dmca complaint against perfect10 and use the same examples/wording etc , it wont help your own website but it might make them think twice about sending unsubstanciated claims

Dirty F 01-11-2006 05:47 PM

Nothing will happen. From all the lawsuits topics on gfy maybe 1 or 2 times something actually happend.

Dont post here just do it.

SmokeyTheBear 01-11-2006 05:49 PM

if MR:A sells content to MR:B and MR:C and MR:B files a dmca complaint about MR:C , then MR:C should be just as able to file a complaint against MR:B , although MR:A really is the only one who has the legal authority to file the dmca ( as fa as i understand it )

sfera 01-11-2006 05:50 PM

I don't think so, it's helped me add a few sponsors to my 'do not promote' list. It's too bad for them really but if they're going to use content from a shithead then I have no choice; I'm not going to take the chance of getting banned by Google (or whoever else).

getting it all wrong: sponsors are NOT using content from perfect10, in 1 case perfect10 just bought 300 pics on a non exclusive base from a sponsor, in ALL the other cases, perfect10 has no claim, other than that they have pics with the same models

yes, this guy is nuts, beyond reason and can only do this because he's filthy rich and has the time

Troels 01-12-2006 04:30 AM

If this happened to me I'd be pissed as well. Perfect10.com is not a strong site in google terms. It's wide open for a google-jacking, which will remove perfect10.com from their index.

who 01-12-2006 04:46 AM

some guy said to me:

"I can get perfect10.com banned from Google out of spite, if you wish."

What should I say to him...?

Notice what it says in his sig is exactly what your GFY nickname is, it's done automagically by a script in an attempt to catch the person's attention.

Have a good day.

best of luck guys
