caution & beware that if you use promo content & make a thumbnail of a promo pic & use that thumb to send traffic to trades, you ARE violating the tos of many sponsors. Also, I seen some urls posted in the perfect10 threads whining about wtf were they on the list, blah, blah...

If you have thumbnails of ANY image at all that you did not purchase license for, or used for sponsor promo, you ARE violating copyright law & DMCA.

also note, that if you are using sponsor promo content & that image is not linked to sponsor who provided that promo, or not used to sell surfer to sponsor, you ARE violating copyright & DMCA as well as sponsor TOS.

The same goes for any content used in creating headers, logos, banners, etc...


keep this in mind when you are using or making thumbs for your tgp, blogs, sites, etc...

spacedog, sorry, but there are already ruling out there permitting the thumbing of images you do not own. In fact, google itself does this as a part of it's google image section, for millions upon millions of images.

However, it could be implied that skim TGPs may have issues (but nobody has ever, from what I can find, legally challenged that situation).

Otherwise, the case law is there.
