This ridiculous prohibition, which would likely imperil much of Usenet, is buried in the so-called Violence Against Women and Department of Justice Reauthorization Act. Criminal penalties include stiff fines and two years in prison.

"The use of the word 'annoy' is particularly problematic," says Marv Johnson, legislative counsel for the American Civil Liberties Union. "What's annoying to one person may not be annoying to someone else."

It's illegal to annoy
A new federal law states that when you annoy someone on the Internet, you must disclose your identity. Here's the relevant language.

"Whoever...utilizes any device or software that can be used to originate telecommunications or other types of communications that are transmitted, in whole or in part, by the Internet... without disclosing his identity and with intent to annoy, abuse, threaten, or harass any person...who receives the communications...shall be fined under title 18 or imprisoned not more than two years, or both."
Buried deep in the new law is Sec. 113, an innocuously titled bit called "Preventing Cyberstalking." It rewrites existing telephone harassment law to prohibit anyone from using the Internet "without disclosing his identity and with intent to annoy."

You also notice how they have to "sneak" this kinda shit in with other bills in the guise of "protecting women" or some shit. What pisses these people off the most is now the average joe has a median for self expression and free speech so we have to quickly whittle that away. this new law is a bit confusing, something seems fishy to me, maybe it's simple but I'm still confused about what exactly this law is about completely and who all will be effected. should be going after spammers and murderers and shit, not a bunch of kids who are arguing on a board over something minor, wtf

I cant see the problem with that? On phone, letters, internet..its the same. Harassment and threaten people has nothing to do with freedom or free expression. If they get additional 2 years in prison, thats fine.

and you think that's all this will be used for? so if someone on GFY annoys you they should get 2 years prision? if you don't see this as a direct tool to stop speech and expression you need to open your eyes

Have to tell you this is a great law. the amount of times girls have used fake names etc to try and cyberstalk me is amazing. Bullshit profiles, stupid pranks and the vicious can be prosecuted. I dig it, honestly. if i could go back and make this retroactive i wiould have 2 people under arrest right fucking now. the damage they did to my life is unfuckinbelievable.

Seriously.. yea.. it will be abused. And that abuse is miles worse than any "annoyance".

It's a stupid law xanx - if someone was seriously harassing or stalking anyone, there are laws already in place to handle this. The concept of "annoying" anyone and this being a criminal offense is absurd.

Either it's a total screwup or a deliberate attempt at some pathetic devious shit.

Like I said, threatening people, like say you gonna kill them, has nothing to do with free speech.
We have some similar law here, and some has already gone to jail or got a fine for threatening others online and via SMS. It was not because they called someone stupid, and I'm not gonna be paranoia about this law....where I live :)
